출입국관리공무원은 외국인이 제46조제1항 각 호의 어느 하나에 해당된다고 의심할 만한 상당한 이유가 있고 도주하거나 도주할 염려가 있으면 지방출입국ㆍ외국인관서의 장으로부터 보호명령서를 발급받아 그 외국인을 보호할 수 있다. <개정 2014.3.18>
If an immigration control official has reasonable grounds to suspect that a foreigner falls under any of the subparagraphs of Article 46 (1) and that the foreigner is likely to escape or attempt to escape, the official may detain the foreigner upon receiving a detention order from the head of a regional immigration and foreign affairs office. <Amended on March 18, 2014>
제1항에 따른 보호명령서의 발급을 신청할 때에는 보호의 필요성을 인정할 수 있는 자료를 첨부하여 제출하여야 한다.
When applying for the issuance of a detention order pursuant to Paragraph ①, documentation proving the necessity of detention must be attached and submitted.
출입국관리공무원은 외국인이 제46조제1항 각 호의 어느 하나에 해당된다고 의심할 만한 상당한 이유가 있고 도주하거나 도주할 염려가 있는 긴급한 경우에 지방출입국ㆍ외국인관서의 장으로부터 보호명령서를 발급받을 여유가 없을 때에는 그 사유를 알리고 긴급히 보호할 수 있다. <개정 2014.3.18>
If an immigration control official has reasonable grounds to suspect that a foreigner falls under any of the subparagraphs of Article 46 (1) and that the foreigner is likely to escape or attempt to escape, and if it is an urgent case where there is no time to obtain a detention order from the head of a regional immigration and foreign affairs office, the official may urgently detain the foreigner after informing them of the reason. <Amended on March 18, 2014>
출입국관리공무원은 제3항에 따라 외국인을 긴급히 보호하면 즉시 긴급보호서를 작성하여 그 외국인에게 내보여야 한다.
If an immigration control official urgently detains a foreigner pursuant to Paragraph ③, the official shall immediately prepare an urgent detention certificate and show it to the foreigner.
출입국관리공무원은 제3항에 따라 외국인을 보호한 경우에는 48시간 이내에 보호명령서를 발급받아 외국인에게 내보여야 하며, 보호명령서를 발급받지 못한 경우에는 즉시 보호를 해제하여야 한다.
If an immigration control official detains a foreigner pursuant to Paragraph ③, the official must obtain a detention order and show it to the foreigner within 48 hours; if a detention order is not obtained, the foreigner shall be released immediately.
