제56조의3 피보호자 인권의 존중 등

피보호자의 인권은 최대한 존중하여야 하며, 국적, 성별, 종교, 사회적 신분 등을 이유로 피보호자를 차별하여서는 아니 된다. <개정 2014.12.30>
The human rights of the protected person shall be respected to the maximum extent, and the protected person shall not be discriminated against for reasons of nationality, gender, religion, social status, etc. <Amended by Act No. 12941, Dec. 30, 2014>
남성과 여성은 분리하여 보호하여야 한다. 다만, 어린이의 부양 등 특별한 사정이 있는 경우에는 그러하지 아니하다. <신설 2016.3.29>
Men and women shall be housed separately. Provided, however, that this shall not apply in cases where there are special circumstances, such as the care of children. <Newly established by Act No. 13170, Mar. 29, 2016>
지방출입국ㆍ외국인관서의 장은 피보호자가 다음 각 호의 어느 하나에 해당하는 외국인인 경우에는 특별히 보호하여야 한다. <신설 2014.12.30, 2016.3.29>
1. 환자
2. 임산부
3. 노약자
4. 19세 미만인 사람
5. 제1호부터 제4호까지에 준하는 사람으로서 지방출입국ㆍ외국인관서의 장이 특별히 보호할 필요가 있다고 인정하는 사람
The head of a local immigration office and foreigners office shall provide special protection to a protected person who falls under any of the following subparagraphs: <Newly established by Act No. 12941, Dec. 30, 2014, Act No. 13170, Mar. 29, 2016> 1. Patients 2. Pregnant women 3. The elderly and the infirm 4. Persons under 19 years of age 5. Persons who are equivalent to those referred to in subparagraphs 1 through 4 and whom the head of a local immigration office and foreigners office deems to require special protection.
제3항에 따른 보호를 위한 특별한 조치 및 지원에 관한 구체적인 사항은 법무부령으로 정한다. <신설 2014.12.30, 2016.3.29>
