제71조 출입국의 정지 등

지방출입국ㆍ외국인관서의 장은 제69조제3항에 따른 심사 결과 위법한 사실을 발견하였을 때에는 관계 승무원 또는 승객의 출국이나 입국을 정지시킬 수 있다. <개정 2014.3.18>
The head of a local immigration office may suspend the exit or entry of a relevant crew member or passenger when, as a result of an examination under Article 69 (3), he/she discovers an unlawful act. <Amended by Act No. 12404, Mar. 18, 2014>
제1항에 따른 출입국의 정지는 위법한 사실의 조사에 필요한 기간에만 할 수 있다.
The suspension of entry and exit under paragraph ① shall only be for the period necessary for the investigation of the unlawful act.
제2항에 따른 조사를 마친 뒤에도 계속하여 출입국을 금지하거나 정지시킬 필요가 있을 때에는 제4조ㆍ제11조 또는 제29조에 따른 법무부장관의 결정을 받아야 한다.
If it is necessary to continue to prohibit or suspend entry and exit even after the investigation under paragraph ② is completed, a decision from the Minister of Justice under Article 4, Article 11, or Article 29 shall be obtained.
지방출입국ㆍ외국인관서의 장은 제1항, 제4조 또는 제29조에 따라 승객이나 승무원의 출국을 금지하거나 정지시키기 위하여 필요하다고 인정하면 선박등에 대하여 출항의 일시정지 또는 회항(回航)을 명하거나 선박등에 출입하는 것을 제한할 수 있다. <개정 2014.3.18>
If the head of a local immigration office deems it necessary to prohibit or suspend the exit of a passenger or crew member under paragraph ①, Article 4, or Article 29, he/she may order the temporary suspension of departure or rerouting of a vessel, etc., or restrict entry to or exit from a vessel, etc. <Amended by Act No. 12404, Mar. 18, 2014>
지방출입국ㆍ외국인관서의 장은 제4항에 따라 선박등에 대하여 출항의 일시정지 또는 회항을 명하거나 출입을 제한하는 경우에는 지체 없이 그 사실을 선박등의 장이나 운수업자에게 통보하여야 한다. 출항의 일시정지ㆍ회항명령 또는 출입제한을 해제한 경우에도 또한 같다. <개정 2014.3.18>
If the head of a local immigration office orders the temporary suspension of departure or rerouting of a vessel, etc., or restricts entry to or exit from a vessel, etc. under paragraph ④, he/she shall promptly notify the master or transporter of the vessel, etc. of the fact. 제4항에 따른 선박등의 출항의 일시정지 등은 직무수행에 필요한 최소한의 범위에서 하여야 한다.
