Article 73-2 (Access to and Provision of Passenger Reservation Information, etc.)
제73조의2 승객예약정보의 열람 및 제공 등

운수업자는 출입국관리공무원이 다음 각 호의 어느 하나에 해당하는 업무를 수행하기 위하여 예약정보의 확인을 요청하는 경우에는 지체 없이 예약정보시스템을 열람하게 하거나 표준화된 전자문서로 제출하여야 한다. 다만, 법무부령으로 정하는 부득이한 사유로 표준화된 전자문서로 제출할 수 없을 때에는 지체 없이 그 사유를 밝히고 서류로 제출할 수 있다.
1. 제7조제1항ㆍ제7조의2 또는 제12조의3제1항을 위반하였거나 위반하였다고 의심할 만한 상당한 이유가 있는 사람에 대한 조사
2. 제11조제1항 각 호의 어느 하나에 해당하거나 해당한다고 의심할 만한 상당한 이유가 있는 사람에 대한 조사
A carrier shall, without delay, allow an immigration official to access the reservation information system or submit the reservation information in a standardized electronic document when requested for the purpose of performing any of the following duties: Provided, That if it is impossible to submit the information in a standardized electronic document due to unavoidable reasons prescribed by decree of the Minister of Justice, the carrier may submit it in paper form without delay, stating the reasons. 1. Investigation of a person who has violated or is reasonably suspected of having violated Article 7 (1), Article 7-2, or Article 12-3 (1). 2. Investigation of a person who falls under or is reasonably suspected of falling under any subparagraph of Article 11 (1).
제1항에 따라 열람하거나 문서로 제출받을 수 있는 자료의 범위는 다음 각 호로 한정한다.
1. 성명, 국적, 주소 및 전화번호
2. 여권번호, 여권의 유효기간 및 발급국가
3. 예약 및 탑승수속 시점
4. 여행경로와 여행사
5. 동반 탑승자와 좌석번호
6. 수하물(手荷物)
7. 항공권의 구입대금 결제방법
8. 여행출발지와 최종목적지
9. 예약번호
The scope of data that may be accessed or submitted in document form pursuant to paragraph (1) shall be limited to the following. 1. Name, nationality, address, and telephone number 2. Passport number, passport expiration date, and issuing country 3. Time of reservation and check-in 4. Travel route and travel agency 5. Accompanying passengers and seat number 6. Baggage 7. Method of payment for air ticket purchase 8. Place of departure and final destination 9. Reservation number
운수업자는 출입국관리공무원이 승객의 안전과 정확하고 신속한 출입국심사를 위하여 탑승권을 발급받으려는 승객에 대한 다음 각 호의 자료를 요청하는 경우에는 지체 없이 표준화된 전자문서로 제출하여야 한다. 다만, 법무부령으로 정하는 부득이한 사유로 표준화된 전자문서로 제출할 수 없을 때에는 지체 없이 그 사유를 밝히고 서류로 제출할 수 있다. <개정 2016.3.29, 2020.6.9>

A carrier shall, without delay, submit the following data concerning a passenger who intends to receive a boarding pass in a standardized electronic document when requested by an immigration official for the safety of passengers and for accurate and prompt immigration inspection: Provided, That if it is impossible to submit the information in a standardized electronic document due to unavoidable reasons prescribed by decree of the Minister of Justice, the carrier may submit it in paper form without delay, stating the reasons. <Amended by Act No. 13972, Mar. 29, 2016; Act No. 17377, Jun. 9, 2020> 1. Name, sex, date of birth, and nationality 2. Passport number and reservation number 3. Flight of departure, place of departure, and time of departure 4. Place of arrival and time of arrival 5. 제1항과 제3항에 따라 자료를 열람하거나 문서로 제출하여 줄 것을 요청할 수 있는 출입국관리공무원은 지방출입국ㆍ외국인관서의 장이 지정하는 사람으로 한정한다. <개정 2014.3.18>
The immigration officials who may request access to or submission of data pursuant to paragraphs (1) and (3) shall be limited to those designated by the head of a regional immigration office. <Amended by Act No. 12423, Mar. 18, 2014>
제4항에 따라 지정된 출입국관리공무원은 제출받은 자료를 검토한 결과 이 법에 따른 출국 또는 입국 요건을 갖추지 못하여 선박등에 탑승하기에 부적당한 사람이 발견된 경우에는 그 사람의 탑승을 방지하도록 선박등의 장이나 운수업자에게 통보할 수 있다. <신설 2016.3.29>
If an immigration official designated pursuant to paragraph (4) discovers, upon reviewing the submitted data, a person who does not meet the requirements for departure or entry under this Act and is therefore unfit to board a vessel, etc., such official may notify the captain of the vessel, etc. or the carrier to prevent that person from boarding. <Newly Inserted by Act No. 13972, Mar. 29, 2016>
제4항에 따라 지정된 출입국관리공무원은 직무상 알게 된 예약정보시스템의 자료를 누설하거나 권한 없이 처리하거나 다른 사람의 이용에 제공하는 등 부당한 목적을 위하여 사용하여서는 아니 된다. <개정 2016.3.29>
An immigration official designated pursuant to paragraph (4) shall not disclose data from the reservation information system learned in the course of duty, process it without authorization, or use it for improper purposes such as providing it for the use of others. <Amended by Act No. 13972, Mar. 29, 2016>
제1항과 제3항에 따른 자료의 열람과 제출 시기 등에 관한 구체적인 사항은 대통령령으로 정한다. <개정 2016.3.29>
Detailed matters concerning the timing of access to and submission of data pursuant to paragraphs (1) and (3), etc. shall be prescribed by Presidential Decree. <Amended by Act No. 13972, Mar. 29, 2016>
