제78조 관계 기관의 협조

출입국관리공무원은 다음 각 호의 조사에 필요하면 관계 기관이나 단체에 자료의 제출이나 사실의 조사 등에 대한 협조를 요청할 수 있다.

An immigration official may request cooperation from related agencies or organizations, such as the submission of data or investigation of facts, if deemed necessary for investigations under the following subparagraphs. 1. Investigation pursuant to Article 47 2. Deleted <2012.2.10> 3. Investigation of immigration offenders
법무부장관은 다음 각 호의 직무를 수행하기 위하여 관계 기관에 해당 각 호의 정보 제공을 요청할 수 있다. <개정 2016.3.29, 2017.3.14, 2018.3.20, 2019.4.23, 2020.6.9, 2022.12.13>
1. 출입국심사(정보화기기를 이용하는 출입국심사에 관하여 외국과의 협정이 있는 경우에는 그 협정에 따른 직무수행을 포함한다): 범죄경력정보ㆍ수사경력정보, 여권발급정보ㆍ주민등록정보, 가족관계등록 전산정보 또는 환승 승객에 대한 정보, 외국인 사망자 정보
2. 사증 및 사증발급인정서 발급 심사: 범죄경력정보ㆍ수사경력정보, 관세사범정보, 여권발급정보ㆍ주민등록정보, 사업자의 휴업ㆍ폐업 여부에 대한 정보, 납세증명서, 가족관계등록 전산정보 또는 국제결혼 중개업체의 현황 및 행정처분 정보, 외국인 사망자 정보
3. 외국인체류 관련 각종 허가 심사: 범죄경력정보ㆍ수사경력정보, 범칙금 납부정보ㆍ과태료 납부정보, 여권발급정보ㆍ주민등록정보, 외국인의 자동차등록정보, 사업자의 휴업ㆍ폐업 여부에 대한 정보, 납세증명서, 외국인의 조세체납정보, 외국인의 국민건강보험 및 노인장기요양보험 관련 체납정보, 외국인의 과태료 체납정보, 가족관계등록 전산정보 또는 국제결혼 중개업체의 현황 및 행정처분 정보, 숙박업소 현황, 관광숙박업소의 현황, 외국인관광 도시민박업소의 현황, 한옥체험업소의 현황, 외국인 사망자 정보, 대통령령으로 정하는 외국인의 소득금액 정보
4. 출입국사범 조사: 범죄경력정보ㆍ수사경력정보, 외국인의 범죄처분결과정보, 관세사범정보, 여권발급정보ㆍ주민등록정보, 외국인의 자동차등록정보, 납세증명서, 가족관계등록 전산정보 또는 국제결혼 중개업체의 현황 및 행정처분 정보, 숙박업소 현황, 관광숙박업소의 현황, 외국인관광 도시민박업소의 현황, 한옥체험업소의 현황, 외국인 사망자 정보
5. 사실증명서 발급: 여권발급정보ㆍ주민등록정보 또는 가족관계등록 전산정보
The Minister of Justice may request the provision of information under each of the following subparagraphs from related agencies to perform the duties under each subparagraph. <Amended on Mar. 29, 2016, Mar. 14, 2017, Mar. 20, 2018, Apr. 23, 2019, Jun. 9, 2020, Dec. 13, 2022> 1. Immigration examination (including performance of duties pursuant to agreements with foreign countries regarding immigration examination using information technology equipment): Criminal record information, investigation record information, passport issuance information, resident registration information, electronic family relationship registration information, information on transit passengers, or information on deceased foreigners 2. Examination for issuance of visas and certificates of eligibility for visas: Criminal record information, investigation record information, customs offense information, passport issuance information, resident registration information, information on business suspension or closure of businesses, tax certificates, electronic family relationship registration information, or information on the status and administrative disposition of international marriage brokerage businesses, or information on deceased foreigners 3. Examination for various permits related to foreign stay: Criminal record information, investigation record information, information on payment of fines for violation of law, information on payment of administrative fines, passport issuance information, resident registration information, foreign vehicle registration information, information on business suspension or closure of businesses, tax certificates, foreign tax delinquency information, foreign national health insurance and long-term care insurance delinquency information, foreign administrative fine delinquency information, electronic family relationship registration information, or information on the status and administrative disposition of international marriage brokerage businesses, information on lodging facilities, information on tourism lodging facilities, information on urban minbak businesses for foreign tourists, information on hanok experience businesses, information on deceased foreigners, or income amount information of foreigners as prescribed by Presidential Decree 4. Investigation of immigration offenders: Criminal record information, investigation record information, information on criminal disposition results of foreigners, customs offense information, passport issuance information, resident registration information, foreign vehicle registration information, tax certificates, electronic family relationship registration information, or information on the status and administrative disposition of international marriage brokerage businesses, information on lodging facilities, information on tourism lodging facilities, information on urban minbak businesses for foreign tourists, information on hanok experience businesses, information on deceased foreigners 5. Issuance of certificates of facts: Passport issuance information, resident registration information, or electronic family relationship registration information
제1항에 따른 협조 요청 또는 제2항에 따른 정보제공 요청을 받은 관계 기관이나 단체는 정당한 이유 없이 요청을 거부하여서는 아니 된다. <개정 2016.3.29>
Related agencies or organizations that have received a request for cooperation under paragraph ① or a request for provision of information under paragraph ② shall not refuse the request without just cause. <Amended on Mar. 29, 2016>
제1항에 따라 제출받은 자료 또는 제2항에 따라 제공받은 정보는 「개인정보 보호법」에 따라 보유하고 관리한다. <신설 2016.3.29>
