Article 78-2 (Provision of Basic Personal Information of Foreign Nationals)
제78조의2 외국인 기본인적정보의 제공

법무부장관은 「전자정부법」 제2조제2호에 따른 행정기관 및 같은 조 제3호에 따른 공공기관(이하 이 조에서 "행정기관등"이라 한다)의 장이 외국인에 대한 수사, 공소의 제기ㆍ유지 및 과세 등 관계 법령에 따른 업무에 사용할 외국인 기본인적정보의 제공을 요청하는 경우 이를 제공할 수 있다.
The Minister of Justice may provide the basic personal information of foreign nationals if the heads of administrative agencies, as defined in Article 2(2) of the 「Act on Promotion of Electronic Government and Information and Communication Network Utilization and Information Protection, etc.」, and public institutions, as defined in Article 2(3) of the same Article (hereinafter referred to as "administrative agencies, etc." in this Article), request it for use in duties pursuant to relevant laws and regulations, such as investigations into foreign nationals, the filing and maintenance of prosecutions, and taxation.
행정기관등의 장은 제1항에 따라 제공받은 외국인 기본인적정보를 「개인정보 보호법」에 따라 처리하여야 한다.
The heads of administrative agencies, etc. shall process the basic personal information of foreign nationals provided under paragraph ① in accordance with the 「Personal Information Protection Act」.
제1항에 따른 외국인 기본인적정보의 제공 방법 및 절차 등에 관하여 필요한 사항은 법무부령으로 정한다.
Matters necessary for the methods and procedures of providing the basic personal information of foreign nationals under paragraph ① shall be prescribed by Ordinance of the Ministry of Justice.
법무부장관은 외국인에 대한 수사, 공소의 제기ㆍ유지 및 과세 등 관계 법령에 따른 업무를 수행하는 행정기관등의 장에게 제1항에 따라 외국인 기본인적정보를 제공받아 해당 업무에 사용할 것을 권고할 수 있다.
The Minister of Justice may recommend that the heads of administrative agencies, etc. performing duties pursuant to relevant laws and regulations, such as investigations into foreign nationals, the filing and maintenance of prosecutions, and taxation, receive and use the basic personal information of foreign nationals under paragraph ① for such duties.
