Article 81-3 (Obligation of Foreigners to Provide Information)
제81조의3 외국인의 정보제공 의무

제10조의2제1항제1호에 따른 단기체류자격을 가진 외국인(이하 "숙박외국인"이라 한다)은 「감염병의 예방 및 관리에 관한 법률」에 따른 위기경보의 발령 또는 「국민보호와 공공안전을 위한 테러방지법」에 따른 테러경보의 발령 등 법무부령으로 정하는 경우에 한정하여 다음 각 호의 어느 하나에 해당하는 자(이하 "숙박업자"라 한다)가 경영하는 숙박업소에서 머무는 경우 숙박업자에게 여권 등 법무부령으로 정하는 자료를 제공하여야 한다.
1. 「공중위생관리법」에 따라 숙박업으로 신고한 자
2. 「관광진흥법」에 따라 관광숙박업, 외국인관광 도시민박업 및 한옥체험업으로 등록한 자
A foreigner who holds a short-term stay status under Article 10-2(1) subparagraph 1 (hereinafter referred to as "foreign guest") shall provide to the accommodation provider materials such as passport, as determined by a Ministry of Justice ordinance, when staying at an accommodation facility operated by a person falling under any of the following subparagraphs (hereinafter referred to as "accommodation provider"), limited to cases where a crisis alert under the 「Act on the Prevention and Management of Infectious Diseases」 is issued or a terror alert under the 「Act on Counter-Terrorism for the Protection of the Public and Public Safety」 is issued, etc., as prescribed by a Ministry of Justice ordinance. 1. A person who has reported accommodation business under the 「Public Health Control Act」 2. A person registered for tourism accommodation business, foreign tourist city lodging business, or hanok experience business under the 「Tourism Promotion Act」
숙박업자는 숙박외국인이 제공한 자료를 숙박한 때 또는 제1항에 따른 경보가 발령된 때부터 12시간 이내에 법무부령으로 정하는 정보통신망(이하 "정보통신망"이라 한다)을 통하여 법무부장관에게 제출하여야 한다. 다만, 통신 장애 등 부득이한 사유로 정보통신망으로 제출할 수 없을 때에는 법무부령으로 정하는 방법으로 제출할 수 있다.
The accommodation provider shall submit the information provided by the foreign guest to the Minister of Justice through an information and communication network prescribed by a Ministry of Justice ordinance (hereinafter referred to as "information and communication network") within 12 hours from the time of stay or from the issuance of the alert under paragraph ①. However, if submission through the information and communication network is impossible due to unavoidable reasons such as communication failure, submission may be made by methods prescribed by a Ministry of Justice ordinance.
숙박업자는 제2항에 따른 업무를 수행하기 위하여 수집한 자료를 「개인정보 보호법」에 따라 보유하고 관리한다.
The accommodation provider shall possess and manage the data collected for the performance of duties under paragraph ② in accordance with the 「Personal Information Protection Act」.
법무부장관은 제2항에 따라 제출받은 숙박외국인의 자료를 「개인정보 보호법」에 따라 보유하고 관리한다.
The Minister of Justice shall possess and manage the data of foreign guests received under paragraph ② in accordance with the 「Personal Information Protection Act」.
제2항에 따른 정보통신망의 설치ㆍ운영 및 자료 제출의 절차ㆍ방법에 관하여 필요한 사항은 법무부령으로 정한다.
Matters necessary for the installation and operation of the information and communication network under paragraph ②, and the procedures and methods for submitting data, shall be determined by a Ministry of Justice ordinance.
