제84조 통보의무

국가나 지방자치단체의 공무원이 그 직무를 수행할 때에 제46조제1항 각 호의 어느 하나에 해당하는 사람이나 이 법에 위반된다고 인정되는 사람을 발견하면 그 사실을 지체 없이 지방출입국ㆍ외국인관서의 장에게 알려야 한다. 다만, 공무원이 통보로 인하여 그 직무수행 본연의 목적을 달성할 수 없다고 인정되는 경우로서 대통령령으로 정하는 사유에 해당하는 때에는 그러하지 아니하다. <개정 2012.1.26, 2014.3.18>
If a public official of the State or a local government, in the performance of his/her duties, discovers a person falling under any of the subparagraphs of Article 46(1) or a person who is recognized as being in violation of this Act, he/she shall promptly report the fact to the head of the regional immigration and foreign affairs office. However, this shall not apply in cases where the public official recognizes that the original objective of performing his/her duties cannot be achieved due to the notification, and such cases fall under the grounds prescribed by Presidential Decree. <Amended by 2012.1.26, 2014.3.18>
교도소ㆍ소년교도소ㆍ구치소 및 그 지소ㆍ보호감호소ㆍ치료감호시설 또는 소년원의 장은 제1항에 따른 통보대상 외국인이 다음 각 호의 어느 하나에 해당하면 그 사실을 지체 없이 지방출입국ㆍ외국인관서의 장에게 알려야 한다. <개정 2014.3.18>
1. 형의 집행을 받고 형기의 만료, 형의 집행정지 또는 그 밖의 사유로 석방이 결정된 경우
2. 보호감호 또는 치료감호 처분을 받고 수용된 후 출소가 결정된 경우
3. 「소년법」에 따라 소년원에 수용된 후 퇴원이 결정된 경우
The head of a prison, juvenile prison, detention center and its branch, correctional facility, treatment and rehabilitation facility, or juvenile reformatory shall promptly report to the head of the regional immigration and foreign affairs office if a foreign national subject to notification under paragraph (1) falls under any of the following subparagraphs. <Amended by 2014.3.18> 1. When released from serving a sentence due to expiration of the sentence, suspension of sentence execution, or other reasons. 2. When released from confinement after being admitted for correctional care or treatment and rehabilitation. 3. When discharged from a juvenile reformatory pursuant to the 「Juvenile Act」.
