Article 88-3 (Inspection and Issuance of Foreigner Stay Certificate)
제88조의3 외국인체류확인서 열람ㆍ교부

특정 건물 또는 시설의 소재지를 체류지로 신고한 외국인의 성명과 체류지 변경 일자를 확인할 수 있는 서류(이하 "외국인체류확인서"라 한다)를 열람하거나 교부받으려는 자는 지방출입국ㆍ외국인관서의 장이나 읍ㆍ면ㆍ동의 장 또는 출장소장에게 신청할 수 있다.
A person who wishes to inspect or obtain a document that can confirm the name and date of change of stay of a foreigner who has reported the location of a specific building or facility as their place of stay (hereinafter referred to as the "Foreigner Stay Certificate") may apply to the head of a regional immigration and foreign affairs office, the head of an Eup, Myeon, or Dong, or the head of a branch office.
제1항에 따른 외국인체류확인서 열람이나 교부를 신청할 수 있는 자는 다음 각 호의 어느 하나에 해당하는 자로 한다.
1. 특정 건물이나 시설의 소유자 본인이나 그 세대원, 임차인 본인이나 그 세대원, 매매계약자 또는 임대차계약자 본인
2. 특정 건물 또는 시설의 소유자, 임차인, 매매계약자 또는 임대차계약자 본인의 위임을 받은 자
3. 다음 각 목의 어느 하나에 해당하는 사유로 열람 또는 교부를 신청하려는 자
- 가. 관계 법령에 따라 경매참가자가 경매에 참가하려는 경우
- 나. 「신용정보의 이용 및 보호에 관한 법률」 제2조제5호라목에 따른 신용조사회사 또는 「감정평가 및 감정평가사에 관한 법률」 제2조제4호에 따른 감정평가법인 등이 임차인의 실태 등을 확인하려는 경우
- 다. 대통령령으로 정하는 금융회사 등이 담보주택의 근저당 설정을 하려는 경우
- 라. 법원의 현황조사명령서에 따라 집행관이 현황조사를 하려는 경우
The persons who may apply for inspection or issuance of the Foreigner Stay Certificate under paragraph ① shall be those falling under any of the following subparagraphs: 1. The owner of a specific building or facility, a member of their household, the tenant, a member of their household, the buyer under a sales contract, or the lessee under a lease contract. 2. A person entrusted by the owner of a specific building or facility, the tenant, the buyer under a sales contract, or the lessee under a lease contract. 3. A person applying for inspection or issuance for reasons falling under any of the following: a. When an auction participant intends to participate in an auction pursuant to relevant laws and regulations. b. When a credit investigation company under Article 2, subparagraph 5, item 'a' of the 「Act on the Use and Protection of Credit Information」 or an appraisal company under Article 2, subparagraph 4 of the 「Act on Appraisal and Appraisers」, etc. intends to confirm the status of the tenant. c. When a financial company, etc., as prescribed by Presidential Decree, intends to establish a mortgage on a dwelling house. d. When a bailiff intends to conduct a status investigation pursuant to a court order for status investigation.
외국인체류확인서의 기재사항, 열람ㆍ교부 신청절차, 수수료, 그 밖에 필요한 사항은 법무부령으로 정한다.
The matters to be stated in the Foreigner Stay Certificate, the procedures for applying for inspection and issuance, fees, and other necessary matters shall be prescribed by Ordinance of the Ministry of Justice.
