제90조 신원보증

법무부장관은 사증발급, 사증발급인정서발급, 입국허가, 조건부 입국허가, 각종 체류허가, 외국인의 보호 또는 출입국사범의 신병인도(身柄引渡) 등과 관련하여 필요하다고 인정하면 초청자나 그 밖의 관계인에게 그 외국인(이하 "피보증외국인"이라 한다)의 신원을 보증하게 할 수 있다.
The Minister of Justice may require a person who invites a foreigner, or any other related person, to guarantee the identity of the foreigner (hereinafter referred to as "foreigner under guarantee") if deemed necessary in connection with the issuance of a visa, the issuance of a confirmation of visa issuance, permission to enter, conditional permission to enter, permission for various stays, protection of a foreigner, or the handover of the custody of an immigration offender.
법무부장관은 제1항에 따라 신원보증을 한 사람(이하 "신원보증인"이라 한다)에게 피보증외국인의 체류, 보호 및 출국에 드는 비용의 전부 또는 일부를 부담하게 할 수 있다.
The Minister of Justice may require a person who has guaranteed identity under paragraph ① (hereinafter referred to as "guarantor") to bear all or part of the expenses incurred for the stay, protection, and departure of the foreigner under guarantee.
신원보증인이 제2항에 따른 보증책임을 이행하지 아니하여 국고에 부담이 되게 한 경우에는 법무부장관은 신원보증인에게 구상권(求償權)을 행사할 수 있다.
If the guarantor fails to fulfill his or her guarantee obligation under paragraph ②, thereby causing a burden on the national treasury, the Minister of Justice may exercise subrogation rights against the guarantor.
신원보증인이 제2항에 따른 비용을 부담하지 아니할 염려가 있거나 그 보증만으로는 보증목적을 달성할 수 없다고 인정될 때에는 신원보증인에게 피보증외국인 1인당 300만원 이하의 보증금을 예치하게 할 수 있다.
When it is deemed that the guarantor is likely to fail to bear the expenses under paragraph ②, or that the purpose of the guarantee cannot be achieved solely by the guarantee, the Minister of Justice may require the guarantor to deposit a security deposit of not exceeding 3 million won per foreigner under guarantee.
신원보증인의 자격, 보증기간, 그 밖에 신원보증에 필요한 사항은 법무부령으로 정한다.
The qualifications of the guarantor, the guarantee period, and other matters necessary for the pledge of identity shall be prescribed by Ordinances of the Ministry of Justice.
