①

다음 각 호의 어느 하나에 해당하는 사람은 7년 이하의 징역에 처한다. <개정 2014.1.7>

  1. 1. 이 법에 따라 보호되거나 일시보호된 사람으로서 다음 각 목의 어느 하나에 해당하는 사람

    1. 가. 도주할 목적으로 보호시설 또는 기구를 손괴하거나 다른 사람을 폭행 또는 협박한 사람
    2. 나. 2명 이상이 합동하여 도주한 사람

  2. 2. 이 법에 따른 보호나 강제퇴거를 위한 호송 중에 있는 사람으로서 다른 사람을 폭행 또는 협박하거나 2명 이상이 합동하여 도주한 사람

  3. 3. 이 법에 따라 보호ㆍ일시보호된 사람이나 보호 또는 강제퇴거를 위한 호송 중에 있는 사람을 탈취하거나 도주하게 한 사람

Any person falling under any of the following subparagraphs shall be punished by imprisonment of not more than seven years. <Amended by Act No. 12227, Jan. 7, 2014> 1. A person who is under protection or temporary shelter pursuant to this Act and falls under any of the following items: a. A person who has damaged a protection facility or appliance or assaulted or threatened another person with the intent to escape. b. A person who has escaped in collaboration with two or more other persons. 2. A person who is being escorted for protection or compulsory removal pursuant to this Act and has assaulted or threatened another person or escaped in collaboration with two or more other persons. 3. A person who has aided in the escape or caused the escape of a person under protection or temporary shelter pursuant to this Act, or a person being escorted for protection or compulsory removal.

다음 각 호의 어느 하나에 해당하는 사람으로서 영리를 목적으로 한 사람은 7년 이하의 징역 또는 7천만원 이하의 벌금에 처한다. <개정 2012.1.26, 2014.1.7, 2020.3.24>

  1. 1. 제12조제1항 또는 제2항에 따라 입국심사를 받아야 하는 외국인을 집단으로 불법입국하게 하거나 이를 알선한 사람

  2. 2. 제12조의3제1항을 위반하여 외국인을 집단으로 불법입국 또는 불법출국하게 하거나 대한민국을 거쳐 다른 국가로 불법입국하게 할 목적으로 선박등이나 여권ㆍ사증, 탑승권, 그 밖에 출입국에 사용될 수 있는 서류 및 물품을 제공하거나 알선한 사람

  3. 3. 제12조의3제2항을 위반하여 불법으로 입국한 외국인을 집단으로 대한민국에서 은닉 또는 도피하게 하거나 은닉 또는 도피하게 할 목적으로 교통수단을 제공하거나 이를 알선한 사람

Any person falling under any of the following subparagraphs, who acts for profit, shall be punished by imprisonment of not more than seven years or a fine of not more than seventy million won. <Amended by Act No. 11655, Jan. 26, 2012, Act No. 12227, Jan. 7, 2014, Act No. 17194, Mar. 24, 2020> 1. A person who causes or brokers the collective illegal entry of an alien subject to entry inspection under Article 12 (1) or (2). 2. A person who, in violation of Article 12-3 (1), causes or brokers the collective illegal entry or illegal departure of an alien, or provides or brokers vessels, passports, visas, boarding passes, or any other documents and articles usable for entry and exit for the purpose of illegally entering another country via the Republic of Korea. 3. A person who, in violation of Article 12-3 (2), harbors or aids in the evasion of an alien who has illegally entered the Republic of Korea, or provides or brokers transportation for the purpose of harboring or aiding in the evasion.
