제57조 장해급여

장해급여는 근로자가 업무상의 사유로 부상을 당하거나 질병에 걸려 치유된 후 신체 등에 장해가 있는 경우에 그 근로자에게 지급한다.
Disability benefits shall be paid to a worker who has a physical or other impairment after healing from an injury or illness incurred due to work-related causes.
장해급여는 장해등급에 따라 별표 2에 따른 장해보상연금 또는 장해보상일시금으로 하되, 그 장해등급의 기준은 대통령령으로 정한다.
Disability benefits shall be paid as a disability compensation pension or a lump-sum disability compensation according to the disability grade as specified in attached Table 2; the standards for such disability grades shall be determined by Presidential Decree.
제2항에 따른 장해보상연금 또는 장해보상일시금은 수급권자의 선택에 따라 지급한다. 다만, 대통령령으로 정하는 노동력을 완전히 상실한 장해등급의 근로자에게는 장해보상연금을 지급하고, 장해급여 청구사유 발생 당시 대한민국 국민이 아닌 사람으로서 외국에서 거주하고 있는 근로자에게는 장해보상일시금을 지급한다. <개정 2020.5.26>
The disability compensation pension or lump-sum disability compensation as referred to in paragraph ② shall be paid at the election of the beneficiary. However, a disability compensation pension shall be paid to a worker with a disability grade that completely results in the loss of earning capacity, as determined by Presidential Decree, and a lump-sum disability compensation shall be paid to a worker who is not a national of the Republic of Korea at the time the cause of the claim for disability benefits arises and resides in a foreign country. <Amended by Act No. 17320, May 26, 2020>
장해보상연금은 수급권자가 신청하면 그 연금의 최초 1년분 또는 2년분(제3항 단서에 따른 근로자에게는 그 연금의 최초 1년분부터 4년분까지)의 2분의 1에 상당하는 금액을 미리 지급할 수 있다. 이 경우 미리 지급하는 금액에 대하여는 100분의 5의 비율 범위에서 대통령령으로 정하는 바에 따라 이자를 공제할 수 있다.
Upon application by the beneficiary of a disability compensation pension, up to one-half of the amount equivalent to the first year or the first two years (for a worker falling under the proviso of paragraph ③, up to the first year to the fourth year) of such pension may be paid in advance. In such cases, interest may be deducted from the amount paid in advance within the range of a rate of 5/100, as prescribed by Presidential Decree.
장해보상연금 수급권자의 수급권이 제58조에 따라 소멸한 경우에 이미 지급한 연금액을 지급 당시의 각각의 평균임금으로 나눈 일수(日數)의 합계가 별표 2에 따른 장해보상일시금의 일수에 못 미치면 그 못 미치는 일수에 수급권 소멸 당시의 평균임금을 곱하여 산정한 금액을 유족 또는 그 근로자에게 일시금으로 지급한다.
If the beneficiary's right to receive a disability compensation pension is extinguished pursuant to Article 58, and if the total number of days, calculated by dividing the pension amount already paid by the respective average wage at the time of payment, is less than the number of days for the lump-sum disability compensation according to attached Table 2, an amount calculated by multiplying the deficit number of days by the average wage at the time the right to receive benefits is extinguished shall be paid as a lump sum to the bereaved family or the worker.
