제62조 유족급여

유족급여는 근로자가 업무상의 사유로 사망한 경우에 유족에게 지급한다.
A survivor's benefit shall be paid to the surviving family members when a worker dies due to reasons related to the work.
유족급여는 별표 3에 따른 유족보상연금이나 유족보상일시금으로 하되, 유족보상일시금은 근로자가 사망할 당시 제63조제1항에 따른 유족보상연금을 받을 수 있는 자격이 있는 사람이 없는 경우에 지급한다. <개정 2020.5.26>
A survivor's benefit shall be paid as a survivor's pension or a lump-sum survivor's compensation benefit according to attached Table 3, provided that a lump-sum survivor's compensation benefit shall be paid when there is no person qualified to receive a survivor's pension benefit under Article 63 (1) at the time of the worker's death. <Amended by Act No. 17317, May 26, 2020.>
제2항에 따른 유족보상연금을 받을 수 있는 자격이 있는 사람이 원하면 별표 3의 유족보상일시금의 100분의 50에 상당하는 금액을 일시금으로 지급하고 유족보상연금은 100분의 50을 감액하여 지급한다. <개정 2020.5.26>
If a person qualified to receive a survivor's pension benefit under paragraph (2) so requests, an amount equivalent to 50 percent of the lump-sum survivor's compensation benefit in attached Table 3 shall be paid as a lump sum, and the survivor's pension benefit shall be paid after reducing it by 50 percent. <Amended by Act No. 17317, May 26, 2020.>
유족보상연금을 받던 사람이 그 수급자격을 잃은 경우 다른 수급자격자가 없고 이미 지급한 연금액을 지급 당시의 각각의 평균임금으로 나누어 산정한 일수의 합계가 1,300일에 못 미치면 그 못 미치는 일수에 수급자격 상실 당시의 평균임금을 곱하여 산정한 금액을 수급자격 상실 당시의 유족에게 일시금으로 지급한다. <개정 2020.5.26>
If a person who was receiving a survivor's pension benefit loses the qualification for receipt, and there are no other qualified recipients, and the sum of the number of days calculated by dividing the pension amount already paid by the respective average wage at the time of payment is less than 1,300 days, the amount calculated by multiplying the deficit in days by the average wage at the time of losing qualification for receipt shall be paid as a lump sum to the surviving family members at the time of losing qualification for receipt. <Amended by Act No. 17317, May 26, 2020.>
제2항에 따른 유족보상연금의 지급 기준 및 방법, 그 밖에 필요한 사항은 대통령령으로 정한다.
