Article 65 (Order of Priority of Surviving Family Members as Beneficiaries)
제65조 수급권자인 유족의 순위

제57조제5항ㆍ제62조제2항(유족보상일시금에 한정한다) 및 제4항에 따른 유족 간의 수급권의 순위는 다음 각 호의 순서로 하되, 각 호의 사람 사이에서는 각각 그 적힌 순서에 따른다. 이 경우 같은 순위의 수급권자가 2명 이상이면 그 유족에게 똑같이 나누어 지급한다. <개정 2020.5.26>
1. 근로자가 사망할 당시 그 근로자와 생계를 같이 하고 있던 배우자ㆍ자녀ㆍ부모ㆍ손자녀 및 조부모
2. 근로자가 사망할 당시 그 근로자와 생계를 같이 하고 있지 아니하던 배우자ㆍ자녀ㆍ부모ㆍ손자녀 및 조부모 또는 근로자가 사망할 당시 근로자와 생계를 같이 하고 있던 형제자매
3. 형제자매
The order of priority among surviving family members as beneficiaries under Article 57(5), Article 62(2) (limited to lump-sum survivor's compensation benefits) and paragraph (4) shall be in the order listed in the following subparagraphs, and among persons in each subparagraph, the order shall follow that indicated. In cases where there are two or more beneficiaries with the same priority, the benefits shall be divided equally among them. <Amended by Act No. 17241, May 26, 2020> 1. Spouse, children, parents, grandchildren, and grandparents who were living together with the worker for livelihood at the time of the worker's death. 2. Spouse, children, parents, grandchildren, and grandparents who were not living together with the worker for livelihood at the time of the worker's death, or siblings who were living together with the worker for livelihood at the time of the worker's death. 3. 제1항의 경우 부모는 양부모(養父母)를 선순위로, 실부모(實父母)를 후순위로 하고, 조부모는 양부모의 부모를 선순위로, 실부모의 부모를 후순위로, 부모의 양부모를 선순위로, 부모의 실부모를 후순위로 한다.
In the cases of paragraph (1), adoptive parents shall have priority over natural parents, and parents of adoptive parents shall have priority over parents of natural parents, and adoptive parents of parents shall have priority over natural parents of parents.
수급권자인 유족이 사망한 경우 그 보험급여는 같은 순위자가 있으면 같은 순위자에게, 같은 순위자가 없으면 다음 순위자에게 지급한다.
If a surviving family member who is a beneficiary dies, the insurance benefits shall be paid to a person of the same priority if such a person exists, and if no person of the same priority exists, then to the person of the next priority.
제1항부터 제3항까지의 규정에도 불구하고 근로자가 유언으로 보험급여를 받을 유족을 지정하면 그 지정에 따른다.
Notwithstanding the provisions of paragraphs (1) through (3), if the worker designates a surviving family member to receive insurance benefits by will, the benefits shall be paid according to such designation.
