Article 69 (Occupational Disease Compensation Pension During Re-treatment Period)
제69조 재요양 기간 중의 상병보상연금

재요양을 시작한 지 2년이 지난 후에 부상ㆍ질병 상태가 제66조제1항 각 호의 요건 모두에 해당하는 사람에게는 휴업급여 대신 별표 4에 따른 중증요양상태등급에 따라 상병보상연금을 지급한다. 이 경우 상병보상연금을 산정할 때에는 재요양 기간 중의 휴업급여 산정에 적용되는 평균임금을 적용하되, 그 평균임금이 최저임금액에 70분의 100을 곱한 금액보다 적거나 재요양 당시 평균임금 산정의 대상이 되는 임금이 없을 때에는 최저임금액의 70분의 100에 해당하는 금액을 그 근로자의 평균임금으로 보아 산정한다. <개정 2018.6.12, 2020.5.26>
Where a person whose injury or illness condition, after two years from the commencement of re-treatment, meets all the requirements specified in each subparagraph of Article 66 (1), an occupational disease compensation pension shall be paid in lieu of temporary disability benefits, according to the severe treatment condition grade specified in Appendix 4. In this case, when calculating the occupational disease compensation pension, the average wage applied to the calculation of temporary disability benefits during the re-treatment period shall be used, but if such average wage is less than the amount obtained by multiplying the minimum wage by 100/70, or if there is no wage to be subject to the calculation of the average wage at the time of re-treatment, the amount obtained by multiplying the minimum wage by 100/70 shall be deemed the worker's average wage for calculation. <Amended by Act No. 11821, Jun. 12, 2018; Act No. 17272, May 26, 2020>
제1항에 따른 상병보상연금을 받는 근로자가 장해보상연금을 받고 있으면 별표 4에 따른 중증요양상태등급별 상병보상연금의 지급일수에서 별표 2에 따른 장해등급별 장해보상연금의 지급일수를 뺀 일수에 제1항 후단에 따른 평균임금을 곱하여 산정한 금액을 그 근로자의 상병보상연금으로 한다. <개정 2018.6.12>
Where a worker receiving an occupational disease compensation pension under paragraph ① is receiving a disability compensation pension, the occupational disease compensation pension shall be the amount calculated by multiplying the average wage referred to in the latter part of paragraph ① by the number of days remaining after subtracting the number of days for receiving the disability compensation pension according to the disability grade specified in Appendix 2 from the number of days for receiving the occupational disease compensation pension according to the severe treatment condition grade specified in Appendix 4. <Amended by Act No. 11821, Jun. 12, 2018>
제2항에 따른 상병보상연금을 받는 근로자가 61세가 된 이후에는 별표 5에 따라 산정한 1일당 상병보상연금 지급액에서 제1항 후단에 따른 평균임금을 기준으로 산정한 1일당 장해보상연금 지급액을 뺀 금액을 1일당 상병보상연금 지급액으로 한다. <신설 2010.1.27>
Where a worker receiving an occupational disease compensation pension under paragraph ② reaches the age of 61, the daily occupational disease compensation pension payment shall be the amount obtained by subtracting the daily disability compensation pension payment calculated based on the average wage referred to in the latter part of paragraph ① from the daily occupational disease compensation pension payment calculated according to Appendix 5. <Newly Inserted by Act No. 10009, Jan. 27, 2010>
제1항부터 제3항까지의 규정에도 불구하고 제57조제3항 단서에 따른 장해보상연금을 받는 근로자가 재요양하는 경우에는 상병보상연금을 지급하지 아니한다. 다만, 재요양 중에 중증요양상태등급이 높아지면 제1항 전단에도 불구하고 재요양을 시작한 때부터 2년이 지난 것으로 보아 제2항 및 제3항에 따라 산정한 상병보상연금을 지급한다. <개정 2010.1.27, 2018.6.12, 2020.5.26>
Notwithstanding paragraphs ① through ③, where a worker receiving a disability compensation pension under the proviso of Article 57 (3) undergoes re-treatment, an occupational disease compensation pension shall not be paid. However, if the severe treatment condition grade improves during re-treatment, the occupational disease compensation pension calculated under paragraphs ② and ③ shall be paid, considering the re-treatment as having commenced two years prior, notwithstanding the first part of paragraph ①. <Amended by Act No. 10009, Jan. 27, 2010; Act No. 11821, Jun. 12, 2018; Act No. 17272, May 26, 2020>
