노동위원회에는 전원회의와 위원회의 권한에 속하는 업무를 부문별로 처리하기 위한 위원회로서 다음 각 호의 부문별 위원회를 둔다. 다만, 다른 법률에 특별한 규정이 있는 경우에는 그러하지 아니하다.
1. 심판위원회
2. 차별시정위원회
3. 조정(調停)위원회
4. 특별조정위원회
5. 중재위원회
6. 「교원의 노동조합 설립 및 운영 등에 관한 법률」 제11조제1항에 따른 교원 노동관계 조정위원회
7. 「공무원의 노동조합 설립 및 운영 등에 관한 법률」 제14조제1항에 따른 공무원 노동관계 조정위원회
Each Labor Relations Commission shall have a plenary meeting and divisional committees to handle affairs falling within the authority of the Commission by division. However, this shall not apply where special provisions exist in other Acts. 1. Adjudication Committee 2. Discrimination Remediation Committee 3. Conciliation Committee 4. Special Conciliation Committee 5. Arbitration Committee 6. Teacher Labor Relations Conciliation Committee under Article 11 (1) of the 「Act on the Establishment and Operation of Teachers' Labor Unions, etc.」 7. Public Official Labor Relations Conciliation Committee under Article 14 (1) of the 「Act on the Establishment and Operation of Public Officials' Labor Unions, etc.」
전원회의는 해당 노동위원회 소속 위원 전원으로 구성하며, 다음 각 호의 사항을 처리한다.
1. 노동위원회의 운영 등 일반적인 사항의 결정
2. 제22조제2항에 따른 근로조건의 개선에 관한 권고
3. 제24조 및 제25조에 따른 지시 및 규칙의 제정(중앙노동위원회만 해당한다)
The plenary meeting shall be composed of all members belonging to the Labor Relations Commission and shall handle the following matters: 1. Decision of general matters such as the operation of the Labor Relations Commission 2. Recommendation for improvement of working conditions under Article 22 (2) 3. Issuance of directives and enactment of rules under Articles 24 and 25 (only applicable to the National Labor Relations Commission)
제1항제1호에 따른 심판위원회는 심판담당 공익위원 중 위원장이 지명하는 3명으로 구성하며, 「노동조합 및 노동관계조정법」, 「근로기준법」, 「근로자참여 및 협력증진에 관한 법률」, 그 밖의 법률에 따른 노동위원회의 판정ㆍ의결ㆍ승인 및 인정 등과 관련된 사항을 처리한다.
The Adjudication Committee under subparagraph 1 of paragraph (1) shall be composed of three public interest members in charge of adjudication, designated by the chairperson, and shall handle matters related to judgments, resolutions, approvals, and recognitions of the Labor Relations Commission under the 「Trade Union and Labor Relations Adjustment Act」, the 「Labor Standards Act」, the 「Act on the Promotion of Workers' Participation and Cooperation」, and other Acts.
제1항제2호에 따른 차별시정위원회는 차별시정담당 공익위원 중 위원장이 지명하는 3명으로 구성하며, 「기간제 및 단시간근로자 보호 등에 관한 법률」, 「파견근로자 보호 등에 관한 법률」, 「산업현장 일학습병행 지원에 관한 법률」 또는 「남녀고용평등과 일ㆍ가정 양립 지원에 관한 법률」에 따른 차별적 처우의 시정 등과 관련된 사항을 처리한다. <개정 2019.4.30, 2021.1.5, 2021.5.18>
The Discrimination Remediation Committee under subparagraph 2 of paragraph (1) shall be composed of three public interest members in charge of discrimination remediation, designated by the chairperson, and shall handle matters related to the remediation of discriminatory treatment under the 「Act on the Protection of Temporary and Part-time Workers, etc.」, the 「Act on the Protection of Dispatched Workers, etc.」, the 「Act on the Support for Industrial Field Work-Study Programs」, or the 「Act on the Promotion of Gender Equality in Employment and Work-Life Balance」. <Amended by Act No. 16732, Apr. 30, 2019, Act No. 17876, Jan. 5, 2021, Act No. 18146, May. 18, 2021>
제1항제3호부터 제5호까지의 규정에 따른 조정위원회ㆍ특별조정위원회 및 중재위원회는 「노동조합 및 노동관계조정법」에서 정하는 바에 따라 구성하며, 같은 법에 따른 조정ㆍ중재, 그 밖에 이와 관련된 사항을 각각 처리한다. 이 경우 공익위원은 조정담당 공익위원 중에서 지명한다.
The Conciliation Committee, Special Conciliation Committee, and Arbitration Committee under subparagraphs 3 to 5 of paragraph (1) shall be composed in accordance with the provisions of the 「Trade Union and Labor Relations Adjustment Act」 and shall handle conciliation and arbitration under the same Act, and other related matters, respectively. In this case, public interest members shall be designated from among the public interest members in charge of conciliation.
위원장은 제3항 및 제4항에 따라 부문별 위원회를 구성할 때 위원장 또는 상임위원의 업무가 과도하여 정상적인 업무수행이 곤란하게 되는 등 제25조에 따라 중앙노동위원회가 제정하는 규칙으로 정하는 부득이한 사유가 있는 경우 외에는 위원장 또는 상임위원 1명이 포함되도록 위원을 지명하여야 한다.
When the chairperson organizes divisional committees under paragraphs (3) and (4), he or she shall designate members to include the chairperson or a standing member, unless there are unavoidable reasons prescribed by the rules enacted by the National Labor Relations Commission under Article 25, such as when the workload of the chairperson or a standing member is excessive and hinders normal performance of duties.
위원장은 제3항부터 제5항까지의 규정에도 불구하고 부문별 위원회를 구성할 때 특정 부문별 위원회에 사건이 집중되거나 다른 분야의 전문지식이 필요하다고 인정하는 경우에는 심판담당 공익위원, 차별시정담당 공익위원 또는 조정담당 공익위원을 담당 분야와 관계없이 다른 부문별 위원회의 위원으로 지명할 수 있다.
Notwithstanding paragraphs (3) to (5), when organizing divisional committees, if it is recognized that cases are concentrated in a specific divisional committee or that expertise from another field is required, the chairperson may designate public interest members in charge of adjudication, public interest members in charge of discrimination remediation, or public interest members in charge of conciliation as members of other divisional committees, regardless of their assigned fields.
제1항제6호에 따른 교원 노동관계 조정위원회는 「교원의 노동조합 설립 및 운영 등에 관한 법률」에서 정하는 바에 따라 설치ㆍ구성하며, 같은 법에 따른 조정ㆍ중재, 그 밖에 이와 관련된 사항을 처리한다.
The Teacher Labor Relations Conciliation Committee under subparagraph 6 of paragraph (1) shall be established and composed in accordance with the provisions of the 「Act on the Establishment and Operation of Teachers' Labor Unions, etc.」 and shall handle conciliation and arbitration under the same Act, and other related matters.
제1항제7호에 따른 공무원 노동관계 조정위원회는 「공무원의 노동조합 설립 및 운영 등에 관한 법률」에서 정하는 바에 따라 설치ㆍ구성하며, 같은 법에 따른 조정ㆍ중재, 그 밖에 이와 관련된 사항을 처리한다.
The Public Official Labor Relations Conciliation Committee under subparagraph 7 of paragraph (1) shall be established and composed in accordance with the provisions of the 「Act on the Establishment and Operation of Public Officials' Labor Unions, etc.」 and shall handle conciliation and arbitration under the same Act, and other related matters.
