Article 17-3 (Service by Public Notice)
제17조의3 공시송달

노동위원회는 서류의 송달을 받아야 할 자가 다음 각 호의 어느 하나에 해당하는 경우에는 공시송달을 할 수 있다.
1. 주소가 분명하지 아니한 경우
2. 주소가 국외에 있거나 통상적인 방법으로 확인할 수 없어 서류의 송달이 곤란한 경우
3. 등기우편 등으로 송달하였으나 송달을 받아야 할 자가 없는 것으로 확인되어 반송되는 경우
Where a person who is to receive service of documents falls under any of the following subparagraphs, the Labor Relations Commission may effect service by public notice. 1. Where the address is not clear. 2. Where the address is outside the country or cannot be identified by ordinary means, making service of documents difficult. 3. Where documents sent by registered mail, etc., are returned as confirmed to be undeliverable.
제1항에 따른 공시송달은 노동위원회의 게시판이나 인터넷 홈페이지에 게시하는 방법으로 한다.
Service by public notice under paragraph (1) shall be effected by posting on the bulletin board or Internet homepage of the Labor Relations Commission.
공시송달은 제2항에 따라 게시한 날부터 14일이 지난 때에 효력이 발생한다.
Service by public notice shall take effect 14 days after the date of posting under paragraph (2).
제1항에 따른 공시송달의 요건과 제2항에 따른 공시송달의 방법 및 절차에 필요한 사항은 대통령령으로 정한다.
Matters necessary for the conditions of service by public notice under paragraph (1) and the methods and procedures for service by public notice under paragraph (2) shall be prescribed by Presidential Decree.
