제23조 위원회의 조사권 등

노동위원회는 제2조의2에 따른 소관 사무(제3호의 업무는 제외한다)와 관련하여 사실관계를 확인하는 등 그 사무집행을 위하여 필요하다고 인정할 때에는 근로자, 노동조합, 사용자, 사용자단체, 그 밖의 관계인에 대하여 출석ㆍ보고ㆍ진술 또는 필요한 서류의 제출을 요구하거나 위원장 또는 부문별 위원회의 위원장이 지명한 위원 또는 조사관으로 하여금 사업 또는 사업장의 업무상황, 서류, 그 밖의 물건을 조사하게 할 수 있다. <개정 2016.1.27>
When the Labor Relations Commission deems it necessary for the performance of its duties in relation to the affairs under its jurisdiction as prescribed by Article 2-2 (excluding the work under subparagraph 3), it may require workers, labor unions, employers, employer organizations, or other interested parties to appear, report, state their opinions, or submit necessary documents, or may have the Chairperson or a member or investigator designated by the Chairperson of a divisional committee investigate the business situation, documents, or other objects of a business or workplace. <Amended by Act No. 13715, Jan. 27, 2016>
제1항에 따라 조사하는 위원 또는 조사관은 그 권한을 표시하는 증표를 관계인에게 보여 주어야 한다.
A member or investigator conducting an investigation under paragraph (1) shall show the relevant parties a certificate indicating his or her authority.
노동위원회는 제1항에 따라 관계 당사자 외에 필요하다고 인정되어 출석한 사람에게 대통령령으로 정하는 바에 따라 비용을 변상한다.
The Labor Relations Commission shall reimburse the costs to persons who appear as deemed necessary in addition to the parties concerned under paragraph (1), in accordance with the Presidential Decree.
노동위원회는 심판사건과 차별적 처우 시정사건의 신청인이 제출한 신청서 부본을 다른 당사자에게 송달하고 이에 대한 답변서를 제출하도록 하여야 한다.
The Labor Relations Commission shall serve a copy of the application submitted by the applicant in a judgment case and a case for the correction of discriminatory treatment to the other parties and require them to submit a written answer.
노동위원회는 제4항에 따라 다른 당사자가 제출한 답변서의 부본을 지체 없이 신청인에게 송달하여야 한다.
The Labor Relations Commission shall, without delay, serve a copy of the written answer submitted by the other party under paragraph (4) to the applicant.
