제102조 근로감독관의 권한

근로감독관은 사업장, 기숙사, 그 밖의 부속 건물을 현장조사하고 장부와 서류의 제출을 요구할 수 있으며 사용자와 근로자에 대하여 심문(尋問)할 수 있다. <개정 2017.11.28>
A labor inspector may conduct on-site investigations of workplaces, dormitories, and other attached buildings, request the submission of books and documents, and interrogate employers and workers. <Amended by Act No. 14901, Nov. 28, 2017>
의사인 근로감독관이나 근로감독관의 위촉을 받은 의사는 취업을 금지하여야 할 질병에 걸릴 의심이 있는 근로자에 대하여 검진할 수 있다.
A labor inspector who is a medical doctor, or a medical doctor appointed by a labor inspector, may conduct medical examinations of workers suspected of having an illness for which employment is prohibited.
제1항 및 제2항의 경우에 근로감독관이나 그 위촉을 받은 의사는 그 신분증명서와 고용노동부장관의 현장조사 또는 검진지령서(檢診指令書)를 제시하여야 한다. <개정 2010.6.4, 2017.11.28>
In cases under paragraphs ① and ②, the labor inspector or the medical doctor appointed by the labor inspector shall present their identification and a directive for on-site investigation or medical examination from the Minister of Employment and Labor. <Amended by Act No. 10331, Jun. 4, 2010; Act No. 14901, Nov. 28, 2017>
제3항의 현장조사 또는 검진지령서에는 그 일시, 장소 및 범위를 분명하게 적어야 한다. <개정 2017.11.28>

근로감독관은 이 법이나 그 밖의 노동 관계 법령 위반의 죄에 관하여 「사법경찰관리의 직무를 행할 자와 그 직무범위에 관한 법률」에서 정하는 바에 따라 사법경찰관의 직무를 수행한다.
A labor inspector shall perform the duties of a judicial police officer in accordance with the 「Act on the Scope of Duties and Appointment of Judicial Police Officers」 concerning offenses in violation of this Act or other labor-related laws.
