사용자(사용자의 「민법」 제767조에 따른 친족 중 대통령령으로 정하는 사람이 해당 사업 또는 사업장의 근로자인 경우를 포함한다)가 제76조의2를 위반하여 직장 내 괴롭힘을 한 경우에는 1천만원 이하의 과태료를 부과한다. <신설 2021.4.13>
An employer (including a relative of the employer under Article 767 of the Civil Act, as prescribed by Presidential Decree, if that person is a worker in the business or workplace) who commits workplace bullying in violation of Article 76-2 shall be subject to an administrative fine of not more than 10 million won. <Newly added 2021.4.13>
다음 각 호의 어느 하나에 해당하는 자에게는 500만원 이하의 과태료를 부과한다. <개정 2009.5.21, 2010.6.4, 2014.3.24, 2017.11.28, 2021.1.5, 2021.4.13, 2021.5.18>
1. 제13조에 따른 고용노동부장관, 노동위원회 또는 근로감독관의 요구가 있는 경우에 보고 또는 출석을 하지 아니하거나 거짓된 보고를 한 자
2. 제14조, 제39조, 제41조, 제42조, 제48조, 제66조, 제74조제7항ㆍ제9항, 제76조의3제2항ㆍ제4항ㆍ제5항ㆍ제7항, 제91조, 제93조, 제98조제2항 및 제99조를 위반한 자
3. 제51조의2제5항에 따른 임금보전방안을 신고하지 아니한 자
4. 제102조에 따른 근로감독관 또는 그 위촉을 받은 의사의 현장조사나 검진을 거절, 방해 또는 기피하고 그 심문에 대하여 진술을 하지 아니하거나 거짓된 진술을 하며 장부ㆍ서류를 제출하지 아니하거나 거짓 장부ㆍ서류를 제출한 자
An administrative fine of not more than 5 million won shall be imposed on any person who falls under any of the following subparagraphs. <Amended 2009.5.21, 2010.6.4, 2014.3.24, 2017.11.28, 2021.1.5, 2021.4.13, 2021.5.18> 1. A person who fails to report or attend, or makes a false report, when requested by the Minister of Employment and Labor, the Labor Relations Commission, or a labor inspector under Article 13. 2. A person who violates Articles 14, 39, 41, 42, 48, 66, Article 74, paragraphs 7 and 9, Article 76-3, paragraphs 2, 4, 5, and 7, Articles 91, 93, Article 98, paragraph 2, and Article 99. 3. A person who fails to report the wage preservation plan under Article 51-2, paragraph 5. 4. A person who refuses, obstructs, or evades an on-site investigation or medical examination by a labor inspector or a doctor commissioned by him or her under Article 102, and who fails to make a statement or makes a false statement in response to an inquiry, or fails to submit or submits false books or documents.
제1항 및 제2항에 따른 과태료는 대통령령으로 정하는 바에 따라 고용노동부장관이 부과ㆍ징수한다. <개정 2010.6.4, 2021.4.13>
