제80조 장해보상

근로자가 업무상 부상 또는 질병에 걸리고, 완치된 후 신체에 장해가 있으면 사용자는 그 장해 정도에 따라 평균임금에 별표에서 정한 일수를 곱한 금액의 장해보상을 하여야 한다. <개정 2008.3.21>
If a worker sustains an injury or illness arising out of and in the course of employment, and has a physical disability after full recovery, the employer shall provide disability compensation in an amount equal to the number of days specified in the annexed table multiplied by the average wage, according to the degree of the disability. <Amended by Act No. 9495, Mar. 21, 2008>
이미 신체에 장해가 있는 사람이 부상 또는 질병으로 인하여 같은 부위에 장해가 더 심해진 경우에 그 장해에 대한 장해보상 금액은 장해 정도가 더 심해진 장해등급에 해당하는 장해보상의 일수에서 기존의 장해등급에 해당하는 장해보상의 일수를 뺀 일수에 보상청구사유 발생 당시의 평균임금을 곱하여 산정한 금액으로 한다. <신설 2008.3.21, 2020.5.26>
If a person who already has a physical disability sustains an injury or illness that exacerbates the disability in the same body part, the amount of disability compensation for the disability shall be calculated by multiplying the average wage at the time the cause for claiming compensation arises by the number of days obtained by subtracting the number of days for disability compensation corresponding to the existing disability grade from the number of days for disability compensation corresponding to the aggravated disability grade. <Newly Inserted by Act No. 9495, Mar. 21, 2008, Act No. 17272, May 26, 2020>
