중개의뢰인은 중개대상물의 중개를 의뢰하는 경우 특정한 개업공인중개사를 정하여 그 개업공인중개사에 한정하여 해당 중개대상물을 중개하도록 하는 계약(이하 "전속중개계약"이라 한다)을 체결할 수 있다. <개정 2014.1.28, 2020.6.9>
When a client requests brokerage of a brokerage object, they may enter into an agreement to exclusively entrust the brokerage of the relevant brokerage object to a specific licensed real estate agent (hereinafter referred to as an "exclusive brokerage agreement"). <Amended by Act No. 12312, Jan. 28, 2014; Act No. 17367, Jun. 9, 2020>
제1항에 따른 전속중개계약은 국토교통부령으로 정하는 계약서에 의하여야 하며, 개업공인중개사는 전속중개계약을 체결한 때에는 해당 계약서를 국토교통부령으로 정하는 기간 동안 보존하여야 한다. <개정 2008.2.29, 2013.3.23, 2014.1.28, 2020.6.9>
An exclusive brokerage agreement pursuant to Paragraph ① shall be made in a written contract prescribed by the Ordinance of the Ministry of Land, Infrastructure and Transport, and a licensed real estate agent shall preserve the written contract for the period prescribed by the Ordinance of the Ministry of Land, Infrastructure and Transport when entering into an exclusive brokerage agreement. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 11690, Mar. 23, 2013; Act No. 12312, Jan. 28, 2014; Act No. 17367, Jun. 9, 2020>
개업공인중개사는 전속중개계약을 체결한 때에는 제24조에 따른 부동산거래정보망 또는 일간신문에 해당 중개대상물에 관한 정보를 공개하여야 한다. 다만, 중개의뢰인이 비공개를 요청한 경우에는 이를 공개하여서는 아니된다. <개정 2014.1.28, 2020.6.9>
When entering into an exclusive brokerage agreement, a licensed real estate agent shall disclose information regarding the brokerage object on the real estate transaction information network pursuant to Article 24 or in a daily newspaper. 전속중개계약의 유효기간, 공개하여야 할 정보의 내용 그 밖에 필요한 사항은 대통령령으로 정한다.
