제26조 거래계약서의 작성 등

개업공인중개사는 중개대상물에 관하여 중개가 완성된 때에는 대통령령으로 정하는 바에 따라 거래계약서를 작성하여 거래당사자에게 교부하고 대통령령으로 정하는 기간 동안 그 원본, 사본 또는 전자문서를 보존하여야 한다. 다만, 거래계약서가 공인전자문서센터에 보관된 경우에는 그러하지 아니하다. <개정 2014.1.28, 2018.8.14, 2020.6.9>
When brokerage is completed concerning the brokerage subject matter, the licensed real estate agent shall prepare a transaction contract according to the Enforcement Decree, deliver it to the parties to the transaction, and preserve the original, copy, or electronic document for the period prescribed by the Enforcement Decree. 제25조제4항의 규정은 제1항에 따른 거래계약서의 작성에 관하여 이를 준용한다. <개정 2020.6.9>

개업공인중개사는 제1항에 따라 거래계약서를 작성하는 때에는 거래금액 등 거래내용을 거짓으로 기재하거나 서로 다른 둘 이상의 거래계약서를 작성하여서는 아니된다. <개정 2014.1.28, 2020.6.9>
