제30조 손해배상책임의 보장

개업공인중개사는 중개행위를 하는 경우 고의 또는 과실로 인하여 거래당사자에게 재산상의 손해를 발생하게 한 때에는 그 손해를 배상할 책임이 있다. <개정 2014.1.28, 2020.6.9>
A licensed real estate agent shall be liable for compensating for any property damage caused to a transaction party due to his or her intent or negligence in the course of brokerage activities. <Amended by Act No. 12248, Jan. 28, 2014, Act No. 17329, Jun. 9, 2020>
개업공인중개사는 자기의 중개사무소를 다른 사람의 중개행위의 장소로 제공함으로써 거래당사자에게 재산상의 손해를 발생하게 한 때에는 그 손해를 배상할 책임이 있다. <개정 2014.1.28>
A licensed real estate agent shall be liable for compensating for any property damage caused to a transaction party by providing his or her brokerage office as a place for the brokerage activities of another person. <Amended by Act No. 12248, Jan. 28, 2014>
개업공인중개사는 업무를 개시하기 전에 제1항 및 제2항에 따른 손해배상책임을 보장하기 위하여 대통령령으로 정하는 바에 따라 보증보험 또는 제42조에 따른 공제에 가입하거나 공탁을 하여야 한다. <개정 2014.1.28, 2020.6.9>
Before commencing business, a licensed real estate agent shall subscribe to fidelity insurance or join a mutual aid association under Article 42, or make a deposit, as prescribed by Presidential Decree, to guarantee the liability for damages under paragraphs 1 and 2. <Amended by Act No. 12248, Jan. 28, 2014, Act No. 17329, Jun. 9, 2020>
제3항에 따라 공탁한 공탁금은 개업공인중개사가 폐업 또는 사망한 날부터 3년 이내에는 이를 회수할 수 없다. <개정 2014.1.28, 2020.6.9>

개업공인중개사는 중개가 완성된 때에는 거래당사자에게 손해배상책임의 보장에 관한 다음 각 호의 사항을 설명하고 관계 증서의 사본을 교부하거나 관계 증서에 관한 전자문서를 제공하여야 한다. <개정 2014.1.28>
