제34조 개업공인중개사등의 교육

제9조에 따라 중개사무소의 개설등록을 신청하려는 자(법인의 경우에는 사원ㆍ임원을 말하며, 제13조제3항에 따라 분사무소의 설치신고를 하려는 경우에는 분사무소의 책임자를 말한다)는 등록신청일(분사무소 설치신고의 경우에는 신고일을 말한다)전 1년 이내에 시ㆍ도지사가 실시하는 실무교육(실무수습을 포함한다)을 받아야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 자는 그러하지 아니하다. <개정 2008.2.29, 2008.6.13, 2013.6.4, 2014.1.28, 2020.6.9>
1. 폐업신고 후 1년 이내에 중개사무소의 개설등록을 다시 신청 하려는 자
2. 소속공인중개사로서 고용관계 종료 신고 후 1년 이내에 중개사무소의 개설등록을 신청하려는 자
Any person intending to apply for registration of a real estate brokerage office pursuant to Article 9 (in the case of a juristic person, refers to its employees or directors, and in the case of applying for notification of the establishment of a branch office pursuant to Article 13 (3), refers to the person in charge of the branch office) shall receive practical training (including practical apprenticeship) conducted by the head of a Si/Do (Metropolitan City/Province) before the date of application for registration (or the date of notification for the establishment of a branch office), within one year prior to such date. Provided, however, that this shall not apply to any person falling under any of the following subparagraphs: <Amended by Act No. 10152, Feb. 29, 2008; Act No. 10301, Jun. 13, 2008; Act No. 11780, Jun. 4, 2013; Act No. 12254, Jan. 28, 2014; Act No. 17350, Jun. 9, 2020> 1. Any person who intends to reapply for registration of a real estate brokerage office within one year after filing a report of business suspension. 2. Any person who intends to apply for registration of a real estate brokerage office within one year after filing a report of termination of employment as a licensed real estate agent.
소속공인중개사는 제15조제1항에 따른 고용 신고일 전 1년 이내에 시ㆍ도지사가 실시하는 실무교육을 받아야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 자는 그러하지 아니하다. <신설 2013.6.4, 2014.5.21>
1. 고용관계 종료 신고 후 1년 이내에 고용 신고를 다시 하려는 자
2. 개업공인중개사로서 폐업신고를 한 후 1년 이내에 소속공인중개사로 고용 신고를 하려는 자
A licensed real estate agent shall receive practical training conducted by the head of a Si/Do within one year prior to the date of notification of employment pursuant to Article 15 (1). Provided, however, that this shall not apply to any person falling under any of the following subparagraphs: <Newly Inserted by Act No. 11780, Jun. 4, 2013; Act No. 12151, May 21, 2014> 1. Any person who intends to reapply for notification of employment within one year after filing a report of termination of employment. 2. Any person who intends to file a notification of employment as a licensed real estate agent within one year after filing a report of business suspension as a licensed real estate agent.

A real estate brokerage assistant shall receive job training conducted by the head of a Si/Do or the registration authority within one year prior to the date of notification of employment pursuant to Article 15 (1). 제1항 및 제2항에 따른 실무교육을 받은 개업공인중개사 및 소속공인중개사는 실무교육을 받은 후 2년마다 시ㆍ도지사가 실시하는 연수교육을 받아야 한다. <개정 2013.6.4, 2014.1.28>
A licensed real estate agent and a licensed real estate agent who have received practical training pursuant to paragraphs (1) and (2) shall receive continuing education conducted by the head of a Si/Do every two years after receiving practical training. <Amended by Act No. 11780, Jun. 4, 2013; Act No. 12254, Jan. 28, 2014>
국토교통부장관은 제1항부터 제4항까지의 규정에 따라 시ㆍ도지사가 실시하는 실무교육, 직무교육 및 연수교육의 전국적인 균형유지를 위하여 필요하다고 인정하면 해당 교육의 지침을 마련하여 시행할 수 있다. <개정 2013.6.4>
The Minister of Land, Infrastructure and Transport may establish and implement guidelines for the practical training, job training, and continuing education conducted by the heads of Si/Do pursuant to paragraphs (1) through (4) if deemed necessary for the balanced maintenance of such training nationwide. <Amended by Act No. 11780, Jun. 4, 2013>
제1항부터 제5항까지의 규정에 따른 교육 및 교육지침에 관하여 필요한 사항은 대통령령으로 정한다. <개정 2013.6.4>
Matters necessary for the education and training guidelines pursuant to paragraphs (1) through (5) shall be prescribed by Presidential Decree. <Amended by Act No. 11780, Jun. 4, 2013>
