①

법 제45조제1항에 따른 계약은 공단의 이사장과 제20조 각 호에 따른 사람이 유형별 요양기관을 대표하여 체결하며, 계약의 내용은 요양급여의 각 항목에 대한 상대가치점수의 점수당 단가를 정하는 것으로 한다.

A contract pursuant to Article 45(1) of the Act shall be concluded between the President of the Corporation and persons falling under each subparagraph of Article 20, representing the types of medical care institutions, and the content of the contract shall be to determine the unit price per point for the relative value points for each item of medical care benefits.

제1항에 따른 요양급여 각 항목에 대한 상대가치점수는 요양급여에 드는 시간ㆍ노력 등 업무량, 인력ㆍ시설ㆍ장비 등 자원의 양, 요양급여의 위험도 및 요양급여에 따른 사회적 편익 등을 고려하여 산정한 요양급여의 가치를 각 항목 사이에 상대적인 점수로 나타낸 것으로 하며, 보건복지부장관이 심의위원회의 심의ㆍ의결을 거쳐 보건복지부령으로 정하는 바에 따라 고시한다. <개정 2017.3.20>

The relative value points for each item of medical care benefits pursuant to Paragraph ① shall be expressed as relative points between each item, reflecting the value of medical care benefits calculated by considering the workload such as time and effort required for medical care benefits, the amount of resources such as personnel, facilities, and equipment, the risk of medical care benefits, and the social benefits derived from medical care benefits, and shall be publicly announced by the Minister of Health and Welfare in accordance with the provisions of the Ordinance of the Ministry of Health and Welfare after deliberation and resolution by the Deliberation Committee. <Amended by Act No. 14074, Mar. 20, 2017>

제2항에도 불구하고 다음 각 호의 경우에는 다음 각 호의 구분에 따른 방법으로 요양급여의 상대가치점수를 산정할 수 있다. <개정 2015.6.30, 2015.11.18, 2017.7.24, 2019.7.2, 2021.6.29>

1. 「의료법」 제3조제2항제3호라목에 따른 요양병원(「장애인복지법」 제58조제1항제4호에 따른 장애인 의료재활시설로서 「의료법」 제3조의2의 요건을 갖춘 의료기관인 요양병원은 제외한다)에서 입원진료를 받는 경우: 해당 진료에 필요한 요양급여 각 항목의 점수와 약제ㆍ치료재료의 비용을 합산하여 증세의 경중도(輕重度)의 구분에 따른 1일당 상대가치점수로 산정
2. 「의료법」 제3조제2항제1호가목에 따른 의원, 같은 항 제3호가목 및 라목부터 바목까지의 규정에 따른 병원ㆍ요양병원ㆍ정신병원ㆍ종합병원, 같은 법 제3조의4에 따른 상급종합병원 또는 「지역보건법」 제12조에 따른 보건의료원에서 보건복지부장관이 정하여 고시하는 질병군[진단명, 시술명, 중증도(重症度), 나이 등을 기준으로 분류한 환자집단을 말한다]에 대하여 입원진료를 받는 경우: 해당 진료에 필요한 요양급여 각 항목의 점수와 약제ㆍ치료재료의 비용을 포괄하여 입원 건당 하나의 상대가치점수로 산정
3. 「호스피스ㆍ완화의료 및 임종과정에 있는 환자의 연명의료결정에 관한 법률」 제28조에 따라 호스피스ㆍ완화의료를 받는 경우: 해당 진료에 필요한 요양급여 각 항목의 점수와 약제ㆍ치료재료의 비용을 합산하여 1일당 상대가치점수로 산정

Notwithstanding Paragraph ②, in cases falling under each subparagraph below, the relative value points for medical care benefits may be calculated using the methods according to each subparagraph below. <Amended by Act No. 13374, Jun. 30, 2015; Act No. 13607, Nov. 18, 2015; Act No. 14793, Jul. 24, 2017; Act No. 16475, Jul. 2, 2019; Act No. 18221, Jun. 29, 2021> 1. In cases of receiving inpatient treatment at a nursing hospital under Article 3(2)3.la of the 「Medical Service Act」 (excluding nursing hospitals that are medical institutions meeting the requirements of Article 3-2 of the 「Medical Service Act」 as disability medical rehabilitation facilities under Article 58(1)4. of the 「Act on Welfare of Persons with Disabilities」): Calculated as a daily relative value point based on the severity of symptoms by summing the points for each item of medical care benefits and the cost of drugs and medical supplies necessary for the treatment. 2. In cases of receiving inpatient treatment at a clinic under Article 3(2)1.la of the 「Medical Service Act」, a hospital, nursing hospital, psychiatric hospital, or general hospital under the same Article 3(2)3.la and la to ba, a tertiary general hospital under Article 3-4 of the same Act, or a public health clinic under Article 12 of the 「Regional Public Health Act」 for disease groups (meaning patient groups classified based on diagnostic name, procedure name, severity, age, etc.) designated and publicly announced by the Minister of Health and Welfare: Calculated as a single relative value point per inpatient case by covering the points for each item of medical care benefits and the cost of drugs and medical supplies necessary for the treatment. 3. In cases of receiving hospice and palliative care pursuant to Article 28 of the 「Act on Hospice, Palliative Care and Decisions on Life-Sustaining Treatment for Patients Nearing Death」: Calculated as a daily relative value point by summing the points for each item of medical care benefits and the cost of drugs and medical supplies necessary for the treatment.

제1항에 따라 계약을 체결할 때 상대가치점수가 고시되지 아니한 새로운 요양급여 항목의 비용에 대한 계약은 제2항에 따라 보건복지부장관이 같은 항목의 상대가치점수를 고시하는 날에 체결된 것으로 본다. 이 경우 그 계약은 그 고시일 이후 최초로 실시된 해당 항목의 요양급여부터 적용한다.

When concluding a contract pursuant to Paragraph ①, a contract for the cost of a new item of medical care benefits for which relative value points have not been publicly announced shall be deemed to have been concluded on the date when the Minister of Health and Welfare publicly announces the relative value points for the same item pursuant to Paragraph ②. In this case, the contract shall apply from the first medical care benefits for the relevant item provided after the date of public announcement.
