법 제101조제3항에 따라 공단이 「약사법」에 따른 의약품의 제조업자ㆍ위탁제조판매업자ㆍ수입자ㆍ판매업자 및 「의료기기법」에 따른 의료기기 제조업자ㆍ수입업자ㆍ수리업자ㆍ판매업자ㆍ임대업자(이하 "제조업자등"이라 한다)에 대하여 징수하는 손실에 상당하는 금액(이하 이 조에서 "손실 상당액"이라 한다)은 같은 조 제1항제1호부터 제3호까지의 위반행위로 보험자ㆍ가입자 및 피부양자가 부당하게 부담하게 된 요양급여비용 전액으로 한다.
The amount equivalent to the loss (hereinafter referred to as "amount equivalent to loss" in this Article) collected by the Corporation from manufacturers, contract manufacturers and sellers, importers, and sellers of pharmaceuticals under the Pharmaceutical Affairs Act, and manufacturers, importers, repairers, sellers, and lessors of medical devices under the Medical Devices Act (hereinafter referred to as "manufacturers, etc.") pursuant to Article 101(3) of the Act, shall be the full amount of medical care benefit costs that were unfairly borne by insurers, subscribers, and dependents due to violations of subparagraphs 1 through 3 of Article 101(1) of the Act.
공단은 제조업자등이 동일한 약제ㆍ치료재료에 대하여 법 제101조제1항제1호부터 제3호까지의 위반행위 중 둘 이상의 위반행위를 한 경우에는 각 위반행위에 따른 손실 상당액 중 가장 큰 금액을 손실 상당액으로 징수한다.
When manufacturers, etc. commit two or more violations among those referred to in subparagraphs 1 through 3 of Article 101(1) of the Act for the same medicine or treatment material, the Corporation shall collect the largest amount among the amounts equivalent to the loss for each violation as the amount equivalent to the loss.
공단은 법 제101조제3항에 따라 손실 상당액을 징수하려는 경우에는 다음 각 호의 사항을 포함한 문서로 약제ㆍ치료재료의 제조업자등에게 알려야 한다.
1. 위반행위의 내용 및 법적근거에 관한 사항
2. 징수금액 및 산정내역 등에 관한 사항
3. 납부기한, 납부방법 및 납부장소 등 납부에 필요한 사항
When the Corporation intends to collect the amount equivalent to the loss pursuant to Article 101(3) of the Act, it shall notify the manufacturers, etc. of the medicine or treatment material in writing, including the following: 1. Details of the violation and legal grounds 2. Amount to be collected and details of calculation, etc. 3. Matters necessary for payment, such as the payment deadline, payment method, and payment location
