제81조 민감정보 및 고유식별정보의 처리

공단(법 제112조에 따라 공단의 업무를 위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보, 같은 영 제19조 각 호에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2013.9.26, 2014.11.20, 2022.6.30, 2023.6.20>

2. 법 제14조제1항에 따른 업무에 관한 사무

The Corporation (including those to whom the Corporation's work is delegated under Article 112 of the Act) may process data containing information concerning health under Article 23 of the Personal Information Protection Act, data on criminal records under Article 18(2) of the Enforcement Decree of the same Act, and data containing resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the same Decree, when unavoidable for the performance of the following duties: <Amended by Act No. 2013.9.26, 2014.11.20, 2022.6.30, 2023.6.20> 1. Duties concerning the reporting of workplaces under Article 7 of the Act 2. Duties concerning work under Article 14(1) of the Act 3. Duties concerning the settlement of medical care benefit costs under Article 61 of the Act 4의2. Duties concerning requests for provision of financial information, etc. under Articles 72 and 96(2) of the Act 4의3. Duties concerning the provision of data under Article 81(3) of the Act 5. Duties concerning the disclosure of personal information of delinquents, etc. under Article 83 of the Act 6. Duties concerning objections and administrative litigation under Articles 87 and 90 of the Act 7. Duties concerning reporting, etc. under Article 94 of the Act 8. Duties concerning the sending of data on reduced or evaded income under Article 95 of the Act 8의2. Duties concerning requests for provision of data under Article 96 of the Act 9. 심사평가원은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2013.9.26, 2014.11.20, 2017.3.27>

1의2. 법 제48조에 따른 요양급여 대상 여부의 확인 등에 관한 사무

3. 법 제87조 및 제90조에 따른 이의신청 및 행정소송에 관한 사무
4. 법 제96조에 따른 자료의 제공 요청에 관한 사무
The Health Insurance Review and Assessment Service may process data containing information concerning health under Article 23 of the Personal Information Protection Act, and resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of the same Act, when unavoidable for the performance of the following duties: <Amended by Act No. 2013.9.26, 2014.11.20, 2017.3.27> 1. Duties concerning the reporting of the status of facilities, equipment, and personnel, etc. of medical institutions under Article 43 of the Act 1의2. Duties concerning the confirmation of eligibility for medical care benefits, etc. under Article 48 of the Act 2. Duties concerning work under Article 63(1) of the Act 3. Duties concerning objections and administrative litigation under Articles 87 and 90 of the Act 4. Duties concerning requests for provision of data under Article 96 of the Act
요양기관(제2호의 경우에는 법 제47조제7항에 따라 요양기관을 대행하는 단체를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <신설 2017.3.27, 2023.6.20>
1. 법 제41조제1항에 따른 요양급여의 실시에 관한 사무
2. 법 제47조제1항 또는 제2항에 따른 요양급여비용의 청구에 관한 사무
Medical institutions (including organizations that act on behalf of medical institutions under Article 47(7) of the Act, in the case of item 2) may process data containing information concerning health under Article 23 of the Personal Information Protection Act, or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of the same Act, when unavoidable for the performance of the following duties: <Newly enacted by Act No. 2017.3.27, 2023.6.20> 1. Duties concerning the provision of medical care benefits under Article 41(1) of the Act 2. Duties concerning the claims for medical care benefit costs under Article 47(1) or (2) of the Act
법 제49조제1항에 따른 준요양기관(이하 "준요양기관"이라 한다)은 법 제49조제3항에 따른 요양비 지급 청구에 관한 사무를 수행하기 위하여 불가피한 경우에는 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <신설 2021.6.29, 2023.6.20>
Quasi-medical institutions under Article 49(1) of the Act (hereinafter referred to as "quasi-medical institutions") may process data containing information concerning health under Article 23 of the Personal Information Protection Act, or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of the same Act, when unavoidable for the performance of duties concerning claims for medical care benefit payments under Article 49(3) of the Act: <Newly enacted by Act No. 2021.6.29, 2023.6.20>
법 제51조제2항에 따른 보조기기를 판매한 자(이하 "보조기기 판매업자"라 한다)는 법 제51조제2항 전단에 따른 보험급여 지급 청구에 관한 사무를 수행하기 위하여 불가피한 경우에는 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <신설 2021.6.29, 2023.6.20>
Persons who have sold assistive devices under Article 51(2) of the Act (hereinafter referred to as "assistive device vendors") may process data containing information concerning health under Article 23 of the Personal Information Protection Act, or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of the same Act, when unavoidable for the performance of duties concerning claims for insurance benefit payments under the first part of Article 51(2) of the Act: <Newly enacted by Act No. 2021.6.29, 2023.6.20>
보건복지부장관(법 제111조에 따라 보건복지부장관의 권한을 위임받거나 위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 제1항에 따른 자료를 처리할 수 있다. <개정 2017.3.27, 2021.6.29>
