제81조 민감정보 및 고유식별정보의 처리

①

공단(법 제112조에 따라 공단의 업무를 위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보, 같은 영 제19조 각 호에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2013.9.26, 2014.11.20, 2022.6.30, 2023.6.20>

The Corporation (including those entrusted with the Corporation's duties under Article 112 of this Act) may process data containing health information under Article 23 of the 「Personal Information Protection Act」, criminal record data under subparagraph 2 of Article 18 of the Enforcement Decree of the same Act, and resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under the respective subparagraphs of Article 19 of the same Decree, if unavoidable for the performance of the following duties: <Amended by 2013.9.26, 2014.11.20, 2022.6.30, 2023.6.20> 1. Duties related to workplace notification under Article 7 of this Act 2. Duties related to work under Article 14 (1) of this Act 3. Duties related to the payment of medical care benefits for active-duty soldiers, etc. under Article 60 of this Act 4. Duties related to the settlement of medical care benefit costs under Article 61 of this Act 4의2. Duties related to requests for provision of financial information, etc. under Articles 72 and 96의2 of this Act 4의3. Duties related to the provision of data under Article 81의3 of this Act 5. Duties related to the disclosure of personal information of delinquents, etc. under Article 83 of this Act 6. Duties related to objections and administrative litigation under Articles 87 and 90 of this Act 7. Duties related to notification, etc. under Article 94 of this Act 8. Duties related to the sending of data on reduced or concealed income under Article 95 of this Act 8의2. Duties related to requests for provision of data under Article 96 of this Act 9. Duties related to the payment of rewards under Article 104 of this Act 10. Duties related to the entrustment of work under Article 112 of this Act

심사평가원은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2013.9.26, 2014.11.20, 2017.3.27>

  1. 1. 법 제43조에 따른 요양기관의 시설ㆍ장비 및 인력 등의 현황 신고에 관한 사무

  2. 1의2. 법 제48조에 따른 요양급여 대상 여부의 확인 등에 관한 사무

  3. 2. 법 제63조제1항에 따른 업무에 관한 사무

  4. 3. 법 제87조 및 제90조에 따른 이의신청 및 행정소송에 관한 사무

  5. 4. 법 제96조에 따른 자료의 제공 요청에 관한 사무

The Health Insurance Review and Assessment Service may process data containing health information under Article 23 of the 「Personal Information Protection Act」, and resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of the same Act, if unavoidable for the performance of the following duties: <Amended by 2013.9.26, 2014.11.20, 2017.3.27> 1. Duties related to the reporting of the status of facilities, equipment, and personnel of medical institutions under Article 43 of this Act 1의2. Duties related to the confirmation of eligibility for medical care benefits, etc. under Article 48 of this Act 2. Duties related to work under Article 63 (1) of this Act 3. Duties related to objections and administrative litigation under Articles 87 and 90 of this Act 4. Duties related to requests for provision of data under Article 96 of this Act

요양기관(제2호의 경우에는 법 제47조제7항에 따라 요양기관을 대행하는 단체를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <신설 2017.3.27, 2023.6.20>

  1. 1. 법 제41조제1항에 따른 요양급여의 실시에 관한 사무

  2. 2. 법 제47조제1항 또는 제2항에 따른 요양급여비용의 청구에 관한 사무

Medical institutions (including organizations representing medical institutions under Article 47 (7) of this Act, in the case of subparagraph 2) may process data containing health information under Article 23 of the 「Personal Information Protection Act」 or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of the same Act, if unavoidable for the performance of the following duties: <Newly Inserted by 2017.3.27, 2023.6.20> 1. Duties related to the provision of medical care benefits under Article 41 (1) of this Act 2. Duties related to the claim of medical care benefit costs under Article 47 (1) or (2) of this Act

법 제49조제1항에 따른 준요양기관(이하 "준요양기관"이라 한다)은 법 제49조제3항에 따른 요양비 지급 청구에 관한 사무를 수행하기 위하여 불가피한 경우에는 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <신설 2021.6.29, 2023.6.20>

Quasi-medical institutions under Article 49 (1) of this Act (hereinafter referred to as "quasi-medical institutions") may process data containing health information under Article 23 of the 「Personal Information Protection Act」 or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of the same Act, if unavoidable for the performance of duties related to the claim of medical care expenses under Article 49 (3) of this Act: <Newly Inserted by 2021.6.29, 2023.6.20>

법 제51조제2항에 따른 보조기기를 판매한 자(이하 "보조기기 판매업자"라 한다)는 법 제51조제2항 전단에 따른 보험급여 지급 청구에 관한 사무를 수행하기 위하여 불가피한 경우에는 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <신설 2021.6.29, 2023.6.20>

Persons who have sold assistive devices under Article 51 (2) of this Act (hereinafter referred to as "dealers of assistive devices") may process data containing health information under Article 23 of the 「Personal Information Protection Act」 or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of the same Act, if unavoidable for the performance of duties related to the claim of insurance benefits under the first sentence of Article 51 (2) of this Act: <Newly Inserted by 2021.6.29, 2023.6.20>

보건복지부장관(법 제111조에 따라 보건복지부장관의 권한을 위임받거나 위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 제1항에 따른 자료를 처리할 수 있다. <개정 2017.3.27, 2021.6.29>

  1. 1. 법 제81조제3항에 따른 체납처분 승인에 관한 사무

  2. 2. 법 제88조에 따른 심판청구에 관한 사무

  3. 3. 법 제97조에 따른 보고와 검사 등에 관한 사무

  4. 4. 법 제98조에 따른 업무정지 처분에 관한 사무

  5. 5. 법 제99조에 따른 과징금 부과ㆍ징수에 관한 사무

  6. 6. 법 제100조에 따른 위반사실 공표에 관한 사무

The Minister of Health and Welfare (including those delegated or entrusted with the powers of the Minister of Health and Welfare under Article 111 of this Act) may process data referred to in paragraph (1) if unavoidable for the performance of the following duties: <Amended by 2017.3.27, 2021.6.29> 1. Duties related to the approval of disposition for delinquent payments under Article 81 (3) of this Act 2. Duties related to claims for adjudication under Article 88 of this Act 3. Duties related to reporting and inspection, etc. under Article 97 of this Act 4. Duties related to business suspension orders under Article 98 of this Act 5. Duties related to the imposition and collection of penalty surcharges under Article 99 of this Act 6. Duties related to the public announcement of violations under Article 100 of this Act
