제23조 사망의 추정

법 제15조에 따라 사망으로 추정되는 경우는 다음과 같다.
1. 선박이 침몰, 전복, 멸실 또는 행방불명되거나 항공기가 추락, 멸실 또는 행방불명된 경우에 그 선박이나 항공기에 탔던 자가 그 사고의 발생일부터 3개월 동안 생사를 알 수 없을 때
2. 항행 중의 선박이나 항공기에 탔던 자가 행방불명되어 3개월 동안 생사를 알 수 없을 때
3. 천재지변이나 그 밖에 이에 준하는 사유로 3개월 동안 생사를 알 수 없을 때
The cases where death is presumed pursuant to Article 15 of the Act shall be as follows. 1. When a person on board a vessel that has sunk, capsized, been destroyed, or is missing, or on board an aircraft that has crashed, been destroyed, or is missing, has their life or death unknown for 3 months from the date of the occurrence of the accident. 2. When a person on board a vessel or aircraft in navigation is missing, and their life or death is unknown for 3 months. 3. When a person's life or death is unknown for 3 months due to a natural disaster or other similar cause.
제1항에 따라 사망으로 추정되는 자는 그 사고가 발생한 날이나 행방불명된 날에 사망한 것으로 추정한다.
A person presumed to have died pursuant to paragraph (1) shall be presumed to have died on the date of the occurrence of the accident or the date of being missing.
제1항 각 호의 사유로 생사를 알 수 없었던 자가 사망한 것이 사고가 발생한 날이나 행방불명된 날부터 3개월 이내에 확인되었으나 그 사망의 시기가 분명하지 아니하면 그 사고가 발생한 날이나 행방불명된 날에 사망한 것으로 추정한다.
If a person whose life or death was unknown for the reasons in each subparagraph of paragraph (1) is confirmed to have died within 3 months from the date of the occurrence of the accident or the date of being missing, but the time of death is unclear, such person shall be presumed to have died on the date of the occurrence of the accident or the date of being missing.
