제25조 자녀의 인정 범위 등

법 제19조에 따라 가입기간이 추가 산입되는 자녀는 다음 각 호에 정하는 자(가입기간에 추가 산입하는 때에 이미 사망한 자를 포함한다)로 한다. <개정 2012.8.3, 2025.5.7>
1. 「민법」에 따른 친생자, 인지된 출생자, 양자 및 친양자
2. 「국내입양에 관한 특별법」 및 「국제입양에 관한 법률」에 따라 입양된 자녀
Children whose contribution periods are additionally included pursuant to Article 19 of the Act shall be the persons prescribed in the following subparagraphs (including those who have already died at the time of additional inclusion of contribution periods). <Amended by Act No. 11973, Aug. 3, 2012; Act No. 17674, May 7, 2025> 1. Children by birth under the Civil Act, children acknowledged by birth, adopted children, and children adopted under a special adoption 2. Children adopted under the Act on Special Cases Concerning Adoption of Children and the Act on International Adoption
제1항에 따른 자녀의 부 또는 모(양부모의 경우를 포함한다. 이하 이 항에서 같다)가 노령연금 수급권을 취득한 때에 자녀가 다음 각 호의 어느 하나에 해당하면 해당 부 또는 모의 가입기간을 추가 산입할 수 없다.
1. 다른 사람의 양자로 된 경우
2. 파양(罷養)된 경우
If a child falls under any of the following subparagraphs at the time when the father or mother of the child (including the adoptive parents, hereinafter the same applies in this paragraph) acquires the right to receive an old-age pension, the contribution periods of the said father or mother shall not be additionally included. 1. If the child has been adopted by another person 2. If the child has been dis-adopted (罷養)
법 제19조에 따라 가입자 또는 가입자였던 자가 가입기간에 추가 산입한 자녀에 대하여는 다른 사람이 가입기간에 추가 산입을 할 수 없다.
If a subscriber or a former subscriber additionally includes children under Article 19 of the Act, another person shall not additionally include them in their contribution periods.
