제41조 환수금의 고지 등

공단은 법 제57조제1항에 따른 급여의 환수 사유가 발생하면 20일 이상의 기한을 정하여 환수할 금액(법 제57조제2항에 따른 이자를 포함하며, 이하 "환수금"이라 한다)을 결정하여 고지하여야 한다. <개정 2012.6.29, 2016.11.29>
When a reason for recovery of benefits under Article 57 (1) of the Act occurs, the Corporation shall determine and notify the amount to be recovered (including interest under Article 57 (2) of the Act, hereinafter referred to as "repayment amount") by setting a period of at least 20 days. <Amended by Act No. 14164, Jun. 29, 2012, Act No. 14418, Nov. 29, 2016>
제1항에 따른 기한까지 환수금을 내지 아니하면 20일 이상의 기한을 정하여 독촉하여야 한다. <개정 2012.6.29>

환수금은 다음 각 호에 정하는 바에 따라 매월 분할하여 납부하게 할 수 있다. <개정 2012.6.29>
1. 환수금(분할 납부 신청일을 기준으로 한다. 이하 이 항에서 같다)이 20만원 이상 40만원 미만인 경우 : 2회 이내
2. 환수금이 40만원 이상 120만원 미만인 경우 : 4회 이내
3. 환수금이 120만원 이상 360만원 미만인 경우 : 12회 이내
4. 환수금이 360만원 이상인 경우 : 36회 이내
The repayment amount may be paid in installments monthly according to the following criteria. <Amended by Act No. 14164, Jun. 29, 2012> 1. If the repayment amount (based on the date of application for installment payment; hereinafter the same shall apply in this paragraph) is not less than 200,000 won and less than 400,000 won: Within 2 installments 2. If the repayment amount is not less than 400,000 won and less than 1,200,000 won: Within 4 installments 3. If the repayment amount is not less than 1,200,000 won and less than 3,600,000 won: Within 12 installments 4. If the repayment amount is not less than 3,600,000 won: Within 36 installments
법 제57조제1항에 따른 환수금의 납부의무자는 제3항에 따라 환수금을 분할 납부하는 경우에 분할 납부를 신청한 날이 속하는 달의 다음 달부터 매월 제1항에 따른 납부기한까지 분할 환수금을 납부해야 한다. 이 경우 공단의 귀책사유로 환수금이 발생한 경우를 제외하고는 분할 납부를 신청한 날이 속하는 달부터 분할 납부를 하는 날이 속하는 달의 1개월 전까지의 기간에 대해서는 분할 환수금에 1년 만기 정기예금 이자율을 곱하여 산정한 금액을 분할 환수금에 더하여 납부해야 한다. <신설 2015.6.30, 2016.11.29, 2021.11.30>
When the person obligated to pay the repayment amount under Article 57 (1) of the Act pays the repayment amount in installments under paragraph ③, they shall pay the installment repayment amount each month from the month following the month in which the application for installment payment was made until the payment deadline under paragraph ①. 국민연금공단은 제3항에 따른 환수금을 3개월 이상 계속하여 체납한 경우에는 환수금을 한꺼번에 환수할 수 있다. <개정 2012.6.29, 2015.6.30>
