Article 45-2 (Period of Marriage Excluded from Calculation of Division Pension)
제45조의2 분할연금 산정에서 제외되는 혼인 기간

법 제64조제1항에 따른 혼인 기간을 산정할 때 다음 각 호의 어느 하나에 해당하는 기간은 혼인 기간에서 제외한다.
1. 「민법」 제27조제1항에 따른 실종기간
2. 「주민등록법」 제20조제6항에 따라 거주불명으로 등록된 기간
When calculating the period of marriage under Article 64, Paragraph 1 of the Act, periods falling under any of the following subparagraphs shall be excluded from the period of marriage. 1. Period of disappearance under Article 27, Paragraph 1 of the Civil Act 2. Period registered as having an unknown residence in accordance with Article 20, Paragraph 6 of the Resident Registration Act
제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 기간이 있는 경우에는 그에 따른다.
1. 이혼 당사자 간에 실질적인 혼인관계가 존재하지 아니하였던 것으로 합의한 기간
2. 법원의 재판 등에 의하여 실질적인 혼인관계가 존재하지 아니하였던 것으로 인정된 기간
Notwithstanding Paragraph 1, if there are periods falling under any of the following subparagraphs, they shall apply. 1. Periods for which the parties to the divorce have agreed that a substantial marital relationship did not exist. 2. Periods for which it has been recognized, by court judgment or other means, that a substantial marital relationship did not exist.
법 제61조에 따른 노령연금 수급권자 또는 법 제64조제1항에 따른 분할연금 수급권자는 제1항 및 제2항에 따른 기간이 있는 경우 그 내용을 공단에 신고하여야 한다.
A recipient of an old-age pension under Article 61 or a recipient of a division pension under Article 64, Paragraph 1 of the Act, shall report to the Corporation any period falling under Paragraph 1 and Paragraph 2.
제3항에 따른 신고의 절차 및 방법에 관한 세부사항은 보건복지부령으로 정한다.
Detailed matters concerning the procedure and method of reporting under Paragraph 3 shall be prescribed by the Ordinance of the Ministry of Health and Welfare.
