제52조 반납금의 납부 기한 등

법 제78조제1항에 따라 반환일시금을 지급받은 자가 공단에 반납하여야 할 반환일시금 및 이자(이하 "반납금"이라 한다)는 일시 반납의 경우에는 반납금의 납부신청을 한 날이 속하는 달의 다음 달 말일까지 내고, 분할 반납의 경우에는 반납금의 납부 신청을 한 날이 속하는 달의 다음 달부터 매월 말일까지 내야 한다.

The lump-sum repayment amount and interest to be repaid to the Corporation by a recipient of a lump-sum refund under Article 78(1) of the Act (hereinafter referred to as "Repayment Amount") shall be paid by the end of the month following the month in which the application for repayment was made, in the case of lump-sum repayment, and on a monthly basis by the end of each month, starting from the month following the month in which the application for repayment was made, in the case of installment repayment.

공단은 법 제78조제2항에 따라 반납금을 분할하여 납부하게 하는 경우에는 다음 각 호의 어느 하나에 해당하는 횟수의 범위에서 납부할 자의 신청에 따라 반납금을 가입기간에 산입되는 개월 단위로 나누어 월별로 내게 하여야 한다. <개정 2011.12.8>

1. 가입 기간이 1년 미만인 경우 : 3회
2. 가입 기간이 1년 이상 5년 미만인 경우 : 12회
3. 가입 기간이 5년 이상인 경우 : 24회

2. 분할 납부의 경우: 각 분할 납부금에 대하여 반환일시금을 지급한 날이 속하는 달부터 분할 납부를 하는 날이 속하는 달의 전월까지의 기간 동안 해당 기간 중에 적용되었던 1년 만기 정기예금 이자율에 따라 계산한 금액

The calculation of interest to be added to the lump-sum refund under Article 78(1) and (2) of the Act shall be made according to the methods specified in the following subparagraphs. In this case, if the interest calculation period exceeds one year, interest shall be calculated on an annual basis, compounded to the principal, and then interest thereafter shall be calculated. <Amended on Dec. 8, 2011> 1. In the case of lump-sum payment: The amount calculated according to the interest rate for one-year fixed deposits applied during the period from the month in which the date of lump-sum refund payment falls to the month preceding the month in which the application for repayment is made, with respect to the lump-sum refund. 2. In the case of installment payment: The amount calculated according to the interest rate for one-year fixed deposits applied during the period from the month in which the date of lump-sum refund payment falls to the month preceding the month in which the installment payment is made, with respect to each installment payment.
