제73조 과오납금의 충당 및 반환

공단은 법 제100조에 따른 과오납금이 발생한 경우에는 다음 각 호의 순서대로 우선 충당한다. 이 경우 제3호에 따른 징수금의 충당 방법에 관하여는 제65조를 준용한다. <개정 2010.8.17, 2012.6.29>
1. 체납처분비
2. 환수금과 법 제57조제3항에 따른 연체금
3. 미납된 연금보험료와 법 제97조에 따른 연체금
4. 앞으로 내야 할 1개월분의 연금보험료. 다만, 제2항에 따라 과오납금의 나머지 금액을 반환받을 수 있는 자의 의사에 반하여는 충당할 수 없다.
When an overpaid or underpaid amount occurs pursuant to Article 100 of the Act, the Corporation shall first offset it in the following order. 1. 연금보험료를 납부한 사람(사업장의 폐업이나 사용자의 사망ㆍ행방불명 등으로 사용자에게 반환할 금액을 반환할 수 없는 경우로서 그 반환할 금액 중 해당 사업장의 근로자가 법 제88조제3항에 따라 부담하는 기여금에 대해서는 근로자를 연금보험료를 납부한 사람으로 본다)
2. 법 제73조에 따른 유족연금 수급권자
3. 제1호에 해당하는 사람의 상속인

법 제100조제3항에서 "대통령령으로 정하는 이자"란 다음 각 호의 구분에 따른 날부터 충당하거나 반환하기로 결정한 날까지의 기간에 대하여 법 제100조제1항에 따른 과오납금에 「국세기본법 시행령」 제43조의3제2항에 따른 국세환급가산금의 이율을 곱하여 산정한 금액을 말한다. <개정 2010.8.17, 2012.6.29>
1. 법 제21조의 자격변동 신고에 따라 과오납금이 발생하는 경우: 자격변동 신고를 한 날부터 7일이 지난 날
2. 제1호 외의 경우: 과오납부한 날의 다음날

공단이 제1항에 따라 과오납금을 충당하거나 건강보험공단이 제2항에 따라 과오납금의 나머지 금액을 반환하려면 그 사실을 제2항 각 호에 규정된 사람에게 문서로 알려야 한다. <개정 2010.8.17>
