제73조의2 사업장가입자에 대한 연금보험료의 지원대상

법 제100조의3제1항제1호에서 "대통령령으로 정하는 규모의 사업장"이란 법 제8조에 따른 사업장가입자 중 사용자(법인인 경우에는 대표이사를 말한다. 이하 같다)를 제외한 근로자 수가 다음 각 호의 어느 하나에 해당하는 사업장(「부패방지 및 국민권익위원회의 설치와 운영에 관한 법률」 제2조제1호에 따른 공공기관은 제외한다. 이하 같다)을 말한다. <개정 2016.11.29>
1. 지원신청일이 속하는 달의 말일 현재 근로자 수가 10명 미만이고, 지원신청일이 속하는 연도의 전년도 월평균 근로자 수가 10명 미만인 사업장
2. 지원신청일이 속하는 달의 말일 현재 근로자 수가 10명 미만이고, 지원신청일이 속하는 연도 중 지원신청일이 속하는 달의 직전 3개월(지원신청일이 속하는 연도에 법 제8조제1항에 따른 당연적용사업장이 되어 그 기간이 3개월이 되지 않는 경우에는 당연적용사업장이 된 달부터 지원신청일이 속하는 달까지로 한다) 동안 연속하여 근로자 수가 10명 미만인 사업장
In the application of 「National Pension Act」 Article 100-3 paragraph 1 item 1, 'workplaces of a scale prescribed by Presidential Decree' refers to workplaces where the number of workers, excluding the employer (in the case of a corporation, the representative director; hereinafter the same shall apply) among workplace insured persons under 「National Pension Act」 Article 8, falls under any of the following subparagraphs (excluding public institutions as defined in 「Anti-Corruption and the Civil Rights Commission Establishment and Operation Act」 Article 2 item 1; hereinafter the same shall apply). <Amended by Presidential Decree No. 27634, Nov. 29, 2016> 1. Workplaces where the number of workers as of the last day of the month in which the support application date falls is less than 10, and the average monthly number of workers in the year preceding the year in which the support application date falls is less than 10. 2. Workplaces where the number of workers as of the last day of the month in which the support application date falls is less than 10, and for the three months preceding the month in which the support application date falls during the year in which the support application date falls, the number of workers has continuously been less than 10 (if the workplace becomes a automatically applied workplace under 「National Pension Act」 Article 8 paragraph 1 in the year in which the support application date falls and the period is less than three months, the period shall be from the month the workplace became an automatically applied workplace to the month in which the support application date falls).
제1항에 따라 근로자 수를 산정할 때 해당 사업장에 다음 각 호의 어느 하나에 해당하는 근로자가 있으면 그 기간(제2호의 경우에는 연금보험료 납부의 예외 기간을 말한다) 동안에는 해당 근로자를 뺀 수를 해당 사업장의 근로자 수로 본다. <개정 2016.1.29, 2017.12.19>
1. 「근로기준법」 제74조제1항부터 제3항까지의 규정에 따른 출산전후휴가 또는 유산ㆍ사산 휴가를 사용한 근로자
2. 「남녀고용평등과 일ㆍ가정 양립 지원에 관한 법률」 제19조에 따른 육아휴직으로 법 제91조제1항에 따라 연금보험료 납부의 예외가 된 근로자
3. 「남녀고용평등과 일ㆍ가정 양립 지원에 관한 법률」 제19조의2에 따른 육아기 근로시간 단축을 한 근로자
When calculating the number of workers under paragraph ①, if a workplace has workers falling under any of the following subparagraphs, the number of workers in that workplace shall be the number excluding such workers during the relevant period (in the case of item 2, the period of exception from pension insurance premium payment). <Amended by Presidential Decree No. 27634, Nov. 29, 2016; Presidential Decree No. 28498, Dec. 19, 2017> 1. Workers who are taking maternity leave before and after childbirth, or leave for miscarriage or stillbirth, pursuant to 「Labor Standards Act」 Article 74 paragraphs 1 through 3. 2. Workers who have been exempted from pension insurance premium payment under 「National Pension Act」 Article 91 paragraph 1 due to taking parental leave pursuant to 「Act on Equal Employment and Support for Work-Family Reconciliation」 Article 19. 3. Workers who have reduced their working hours during their childcare period pursuant to 「Act on Equal Employment and Support for Work-Family Reconciliation」 Article 19-2.
제1항에 따라 연금보험료의 지원대상이 된 사업장이 해당 연도에 3개월 연속으로 근로자 수가 10명 이상이 되면 그 사유가 발생한 날이 속하는 달의 다음 달부터 해당 연도의 마지막 달까지 연금보험료의 지원을 중단한다. <신설 2017.12.19>
If a workplace that has become eligible for support of pension insurance premiums under paragraph ① has 10 or more workers for three consecutive months in that year, the support for pension insurance premiums shall be suspended from the month following the month in which the reason occurred until the last month of that year. <Newly Established by Presidential Decree No. 28498, Dec. 19, 2017>
