제76조의2 출연금의 산정 기준 및 용도 등

법 제102조의2제1항에 따라 출연하는 출연금은 건강보험공단이 「국민건강보험법」 제14조제1항제2호(보험료와 그에 따른 징수금의 징수업무에 한정한다) 및 제10호에 따라 수행하는 전체 징수업무 중에서 연금보험료와 그에 따른 징수금의 징수업무(이하 "징수위탁업무"라 한다)가 차지하는 비율을 기준으로 보건복지부장관이 산정한다. 이 경우 징수위탁업무가 차지하는 비율은 보건복지부장관이 고용노동부장관과 협의하여 정한다. <개정 2013.8.6>
The contribution amount contributed pursuant to Article 102-2(1) of the Act shall be calculated by the Minister of Health and Welfare based on the ratio of the contribution collection work (hereinafter referred to as "contribution collection consignment work") to the overall collection work performed by the National Health Insurance Service under Article 14(1)(2) (limited to the collection of insurance premiums and related collection funds) and subparagraph 10 of the National Health Insurance Act. In this case, the ratio of the contribution collection consignment work shall be determined by the Minister of Health and Welfare in consultation with the Minister of Employment and Labor. <Amended by 2013.8.6>
건강보험공단은 제1항의 기준에 따라 산정한 출연금 요구서에 사업운영계획서 등 증빙서류를 첨부하여 매년 5월 31일까지 보건복지부장관에게 제출하여야 한다.
The National Health Insurance Service shall submit the contribution demand statement calculated based on the standards in paragraph ①, along with supporting documents such as the business operation plan, to the Minister of Health and Welfare by May 31st of each year.
보건복지부장관은 출연금이 확정된 때에는 건강보험공단에 통보하여야 한다.
When the contribution amount is finalized, the Minister of Health and Welfare shall notify the National Health Insurance Service.
건강보험공단은 출연금을 다음 각 호의 용도로만 사용하여야 한다.
1. 징수위탁업무를 수행하는 데에 필요한 인건비, 운영경비 및 사업비
2. 징수위탁업무의 수행에 필요한 시설(기자재를 포함한다)의 구입 및 임차 비용
3. 그 밖에 징수위탁업무를 수행하는 데에 수반되는 경비
The National Health Insurance Service shall use the contribution amount only for the following purposes: 1. Personnel expenses, operating expenses, and project expenses necessary for performing the contribution collection consignment work 2. Costs for purchasing and leasing facilities (including equipment) necessary for performing the contribution collection consignment work 3. Other expenses incidental to performing the contribution collection consignment work
보건복지부장관은 건강보험공단이 출연금을 제4항의 용도 외로 사용한 경우에는 그에 해당하는 금액을 회수하여야 한다.
If the National Health Insurance Service uses the contribution amount for purposes other than those in paragraph ④, the Minister of Health and Welfare shall recover the corresponding amount.
건강보험공단은 매 분기(分期)의 다음 달 10일까지 그 분기의 출연금 집행실적을 보건복지부장관에게 보고하여야 한다.
The National Health Insurance Service shall report the execution performance of the contribution amount for each quarter to the Minister of Health and Welfare by the 10th of the month following the end of each quarter.
