공단은 제3자의 행위로 장애연금이나 유족연금의 지급 사유가 발생하여 장애연금이나 유족연금을 지급한 때에는 그 급여액의 범위에서 제3자에 대한 수급권자의 손해배상청구권에 관하여 수급권자를 대위(代位)한다.
When the Corporation pays disability pension or survivor pension due to an act of a third party, it shall be subrogated to the right of claim for damages of the recipient against the third party to the extent of the benefit amount.
제3자의 행위로 장애연금이나 유족연금의 지급 사유가 발생한 경우 그와 같은 사유로 제3자로부터 손해배상을 받았으면 공단은 그 배상액의 범위에서 제1항에 따른 장애연금이나 유족연금을 지급하지 아니한다.
In cases where the cause for payment of disability pension or survivor pension arises from an act of a third party, if the recipient has received damages from the third party for the same cause, the Corporation shall not pay disability pension or survivor pension under paragraph 1 to the extent of the amount of damages received.
