제115조 시효

연금보험료, 환수금, 그 밖의 이 법에 따른 징수금을 징수하거나 환수할 권리는 3년간, 급여(제77조제1항제1호에 따른 반환일시금은 제외한다)를 받거나 과오납금을 반환받을 수급권자 또는 가입자 등의 권리는 5년간, 제77조제1항제1호에 따른 반환일시금을 지급받을 권리는 10년간 행사하지 아니하면 각각 소멸시효가 완성된다. <개정 2009.5.21, 2017.10.24>
The right to collect or recover pension insurance premiums, amounts to be recovered, and other dues to be collected under this Act shall be extinguished by prescription if not exercised for 3 years; the right of a beneficiary or subscriber, etc. to receive benefits (excluding lump-sum refunds under Article 77 (1) 1.) or to receive a refund of overpaid amounts shall be extinguished by prescription if not exercised for 5 years; and the right to receive lump-sum refunds under Article 77 (1) 1. shall be extinguished by prescription if not exercised for 10 years. <Amended by Act No. 9674, May 21, 2009; Act No. 14945, Oct. 24, 2017>
급여를 지급받을 권리는 그 급여 전액에 대하여 지급이 정지되어 있는 동안은 시효가 진행되지 아니한다.
The statute of limitations shall not run during the period when the payment of benefits is suspended for the entire amount of the right to receive benefits.
연금보험료나 그 밖의 이 법에 따른 징수금 등의 납입 고지, 제57조의2제2항 및 제95조제1항에 따른 독촉과 급여의 지급 또는 과오납금 등의 반환청구는 소멸시효 중단의 효력을 가진다. <개정 2009.5.21>
Notification of payment of pension insurance premiums or other dues to be collected under this Act, demands for payment under Article 57-2 (2) and Article 95 (1), and claims for payment of benefits or refund of overpaid amounts, etc. shall have the effect of interrupting the statute of limitations. <Amended by Act No. 9674, May 21, 2009>
제3항에 따라 중단된 소멸시효는 납입 고지나 독촉에 따른 납입 기간이 지난 때부터 새로 진행된다.
The statute of limitations interrupted under paragraph (3) shall commence anew from the date on which the payment period, based on the notification of payment or demand for payment, has expired.
제1항에 따른 급여의 지급이나 과오납금 등의 반환청구에 관한 기간을 계산할 때 그 서류의 송달에 들어간 일수는 그 기간에 산입하지 아니한다.
When calculating the period for claiming payment of benefits or refund of overpaid amounts, etc. under paragraph (1), the number of days taken for the service of documents shall not be included in the period.
