Article 126 (Application to Foreigners)

For foreigners who are currently subscribed or have been subscribed under the main sentence of Paragraph ① (hereinafter referred to as "foreigner subscribers, etc."), the first date of diagnosis for illness or injury must be within the period of residence in the Republic of Korea to apply subparagraph 1 of Article 67 (1). Matters concerning the occurrence, suspension, extinction of the right to receive disability pension, and payment of disability pension to foreigner subscribers, etc. shall be governed by the provisions of Articles 67 (excluding subparagraph 2 of Paragraph 3 of Article 67) through 71. <Newly Inserted by Act No. 12345, May 29, 2016>

The provisions of Articles 77 through 79 shall not apply to foreigner subscribers, etc. However, this shall not apply to foreigners falling under any of the following subparagraphs. <Amended by Act No. 12345, Jan. 28, 2015; Act No. 12345, May 29, 2016> 1. Foreigners for whom their home country's law stipulates that a lump sum payment (meaning an amount calculated based on pension insurance premiums paid during the subscription period) shall be paid to a national of the Republic of Korea when that national of the Republic of Korea does not acquire the right to receive benefits (meaning benefits equivalent to those in subparagraphs 1 through 3 of Article 49) according to the law of their home country and falls under any of the subparagraphs of Paragraph 1 of Article 77. 2. Foreign workers employed in workplaces subject to this Act, under the 「Act on the Employment, etc. of Foreign Workers」. 3. Persons who have a sojourn status allowing industrial training activities under Article 10 of the 「Immigration Act」, have not departed from the designated training location during the required training period, and are employed in a workplace subject to this Act.
