제128조 벌칙

거짓이나 그 밖의 부정한 방법으로 급여를 받은 자는 3년 이하의 징역이나 3천만원 이하의 벌금에 처한다. <개정 2015.1.28>
A person who receives benefits through false or other fraudulent means shall be punished by imprisonment of up to 3 years or a fine of up to 30 million won. <Amended by Act No. 13085, Jan. 28, 2015>
제123조의2제2항을 위반하여 전산정보자료를 같은 조 제1항에 따른 목적 외의 용도로 이용하거나 활용한 자는 3년 이하의 징역 또는 1천만원 이하의 벌금에 처한다. <신설 2020.1.21>
A person who uses or utilizes the computer information data for purposes other than those prescribed in Article 123-2 (1) in violation of Article 123-2 (2) shall be punished by imprisonment of up to 3 years or a fine of up to 10 million won. <Newly Inserted by Act No. 17035, Jan. 21, 2020>
다음 각 호의 어느 하나에 해당하는 자는 1년 이하의 징역이나 1천만원 이하의 벌금에 처한다. <개정 2009.5.21, 2015.1.28, 2020.1.21>
1. 제88조제3항에 따른 부담금의 전부 또는 일부를 사업장가입자에게 부담하게 하거나 제90조제1항에 따라 임금에서 기여금을 공제할 때 기여금을 초과하는 금액을 사업장가입자의 임금에서 공제한 사용자
2. 제95조제2항에 따른 납부 기한까지 정당한 사유 없이 연금보험료를 내지 아니한 사용자
3. 제119조를 위반하여 근로자가 가입자로 되는 것을 방해하거나 부담금의 증가를 기피할 목적으로 정당한 사유 없이 근로자의 승급 또는 임금 인상을 하지 아니하거나 해고나 그 밖의 불리한 대우를 한 사용자
4. 제124조를 위반하여 업무를 수행하면서 알게 된 비밀을 누설한 자

An employer who makes the insured subscriber bear all or part of the contribution under Article 88 (3), or an employer who deducts an amount exceeding the contribution from the wages of the insured subscriber when deducting the contribution from wages under Article 90 (1) 2. An employer who fails to pay the pension insurance premium without justifiable grounds by the payment deadline under Article 95 (2) 3. An employer who, without justifiable grounds, fails to grant a promotion or wage increase to a worker, or dismisses or otherwise treats unfavorably a worker for the purpose of hindering the worker from becoming an insured person or avoiding an increase in contributions, in violation of Article 119 4. A person who discloses confidential information learned while performing duties in violation of Article 124
