다음 각 호의 어느 하나에 해당하는 자는 제6조 본문에도 불구하고 65세가 될 때까지 보건복지부령으로 정하는 바에 따라 국민연금공단에 가입을 신청하면 임의계속가입자가 될 수 있다. 이 경우 가입 신청이 수리된 날에 그 자격을 취득한다. <개정 2008.2.29, 2010.1.18, 2011.6.7, 2011.12.31, 2015.1.28, 2016.5.29>
1. 국민연금 가입자 또는 가입자였던 자로서 60세가 된 자. 다만, 다음 각 목의 어느 하나에 해당하는 자는 제외한다.
- 가. 연금보험료를 납부한 사실이 없는 자
- 나. 노령연금 수급권자로서 급여를 지급받고 있는 자
- 다. 제77조제1항제1호에 해당하는 사유로 반환일시금을 지급받은 자
2. 전체 국민연금 가입기간의 5분의 3 이상을 대통령령으로 정하는 직종의 근로자로 국민연금에 가입하거나 가입하였던 사람(이하 "특수직종근로자"라 한다)으로서 다음 각 목의 어느 하나에 해당하는 사람 중 노령연금 급여를 지급받지 않는 사람
- 가. 제61조제1항에 따라 노령연금 수급권을 취득한 사람
- 나. 법률 제3902호 국민복지연금법개정법률 부칙 제5조에 따라 특례노령연금 수급권을 취득한 사람
Any person who falls under any of the following subparagraphs may, notwithstanding the main clause of Article 6, apply for subscription to the National Pension Service to become a voluntary continued subscriber by the time they reach the age of 65, as prescribed by a Presidential Decree. Persons who are or were subscribers to the National Pension and have reached the age of 60. However, the following shall be excluded: a. Persons who have not paid pension insurance premiums. b. Persons who are receiving benefits as recipients of old-age pension. c. Persons who have received a lump-sum refund for reasons falling under Article 77 (1) 1. 2. Persons who have subscribed or were subscribed to the National Pension as workers in occupations prescribed by a Presidential Decree for at least three-fifths of the total National Pension subscription period (hereinafter referred to as "workers in special occupations"), and who are not receiving old-age pension benefits among those falling under any of the following. a. Persons who have acquired the right to receive old-age pension pursuant to Article 61 (1). b. Persons who have acquired the right to receive special old-age pension pursuant to Article 5 of the Addendum to the Act on the Amendment of the National Welfare Pension Act, Act No. 3902.
임의계속가입자는 보건복지부령으로 정하는 바에 따라 국민연금공단에 신청하면 탈퇴할 수 있다. <개정 2008.2.29, 2010.1.18>

임의계속가입자는 다음 각 호의 어느 하나에 해당하게 된 날의 다음 날에 그 자격을 상실한다. 다만, 제3호의 경우 임의계속가입자가 납부한 마지막 연금보험료에 해당하는 달의 말일이 탈퇴 신청이 수리된 날보다 같거나 빠르고 임의계속가입자가 희망하는 경우에는 임의계속가입자가 납부한 마지막 연금보험료에 해당하는 달의 말일에 그 자격을 상실한다. <개정 2016.5.29>

2. 국적을 상실하거나 국외로 이주한 때
3. 제2항에 따른 탈퇴 신청이 수리된 때
4. 대통령령으로 정하는 기간 이상 계속하여 연금보험료를 체납한 때
Voluntary continued subscribers shall lose their qualification on the day following the date they fall under any of the following subparagraphs.
