Article 17-2 (Calculation of Coverage Period for Months with Partial Pension Insurance Premium Payment)
제17조의2 연금보험료 일부 납부 월의 가입기간 계산

가입기간을 계산할 때 연금보험료의 일부가 납부된 경우에는 그 일부 납부된 보험료를 다른 일부 납부된 월의 미납 연금보험료와 연체금 등에 충당하고, 충당 후 완납된 월은 가입기간에 산입한다. 이 경우 충당의 대상 및 방법, 가입기간의 계산 및 급여의 지급 등에 필요한 사항은 대통령령으로 정한다.
When calculating the coverage period, if a portion of the pension insurance premium has been paid, such partially paid premium shall be applied to the unpaid pension insurance premium and delinquency charges for other months with partial payments, and months for which payment is completed after such application shall be included in the coverage period. In this case, matters necessary for the subjects and methods of application, calculation of the coverage period, and payment of benefits shall be determined by Presidential Decree.
제1항에 따라 충당한 후에도 일부 납부된 연금보험료가 있는 경우에는 이를 최초 연금 지급월에 반환한다. 다만, 가입자 또는 가입자였던 자의 청구가 있는 경우에는 제99조에도 불구하고 일부 납부된 월의 미납된 연금보험료와 연체금 등을 납부받아 해당 월을 가입기간에 산입할 수 있다.
If there are any partially paid pension insurance premiums remaining after application under paragraph ①, they shall be refunded in the first month of pension payment. However, if requested by the subscriber or a former subscriber, notwithstanding Article 99, the unpaid pension insurance premium and delinquency charges for the months with partial payments may be received, and such months may be included in the coverage period.
제2항에 따라 연금보험료 또는 연체금 등을 반환하거나 납부받는 때에는 대통령령으로 정하는 이자를 더하여야 한다.
When refunding or receiving payment of pension insurance premiums or delinquency charges, etc. under paragraph ②, interest as determined by Presidential Decree shall be added.
