Article 18 (Additional Inclusion of Military Service Period in Insured Period)
제18조 군 복무기간에 대한 가입기간 추가 산입

다음 각 호의 어느 하나에 해당하는 자가 노령연금 수급권을 취득한 때(이 조에 따라 가입기간이 추가 산입되면 노령연금 수급권을 취득할 수 있는 경우를 포함한다)에는 복무기간(12개월을 초과하면 12개월로 한다)을 가입기간에 추가로 산입한다. 다만, 「병역법」에 따른 병역의무를 수행한 기간이 6개월 미만인 경우에는 그러하지 아니한다. <개정 2009.6.9, 2013.6.4, 2016.5.29, 2025.4.2>
1. 「병역법」 제5조제1항제1호에 따른 현역병
2. 「병역법」 제2조제1항제7호에 따른 전환복무를 한 사람
3. 「병역법」 제2조제1항제8호에 따른 상근예비역
4. 「병역법」 제2조제1항제10호에 따른 사회복무요원
When a person falling under any of the following subparagraphs acquires the right to receive an old-age pension (including cases where the right to receive an old-age pension can be acquired by additionally including the insured period pursuant to this Article), the period of service (if it exceeds 12 months, it shall be 12 months) shall be additionally included in the insured period. Full-time reservists pursuant to Article 2(1)8 of the Military Service Act 4. Social service personnel pursuant to Article 2(1)10 of the Military Service Act
제1항에도 불구하고 「병역법」에 따른 병역의무를 수행한 기간의 전부 또는 일부가 다음 각 호의 어느 하나에 해당하는 기간에 산입된 경우에는 제1항을 적용하지 아니한다. <개정 2016.5.29>
1. 「공무원연금법」, 「사립학교교직원 연금법」 또는 「별정우체국법」에 따른 재직기간
2. 「군인연금법」에 따른 복무기간
Notwithstanding paragraph ①, if the whole or a part of the period of performing military service obligation pursuant to the Military Service Act is included in any of the following periods, paragraph ① shall not apply. <Amended by Act No. 14159, May 29, 2016> 1. 제1항에 따라 가입기간을 추가로 산입하는데 필요한 재원은 국가가 전부를 부담한다.
The financial resources necessary for additionally including the insured period pursuant to paragraph ① shall be entirely borne by the State.
제1항에 따른 복무기간의 산정 방법 등에 관하여 필요한 사항은 대통령령으로 정한다. <신설 2025.4.2>
