자녀가 있는 가입자 또는 가입자였던 자가 노령연금수급권을 취득한 때(이 조에 따라 가입기간이 추가 산입되면 노령연금수급권을 취득할 수 있는 경우를 포함한다)에는 다음 각 호에 따른 기간을 가입기간에 추가로 산입한다. <개정 2025.4.2>
1. 자녀가 2명 이하인 경우 : 자녀 1명마다 12개월을 더한 개월 수
2. 자녀가 3명 이상인 경우 : 첫째 및 둘째 자녀에 대하여 인정되는 24개월에 2자녀를 초과하는 자녀 1명마다 18개월을 더한 개월 수
Where a subscriber or former subscriber with children acquires the right to receive old-age benefits (including cases where the right to receive old-age benefits can be acquired due to the additional inclusion of contribution periods pursuant to this Article), the periods pursuant to the following subparagraphs shall be additionally included in the contribution periods. <Amended by Act No. xxxx, Apr. 2, 2025> 1. Where there are two or fewer children: The number of months obtained by adding 12 months per child. 2. Where there are three or more children: The number of months obtained by adding 18 months per child exceeding two children to the 24 months recognized for the first and second children.
제1항에 따른 추가 가입기간은 부모가 모두 가입자 또는 가입자였던 자인 경우에는 부와 모의 합의에 따라 2명 중 1명의 가입기간에만 산입하되, 합의하지 아니한 경우에는 균등 배분하여 각각의 가입기간에 산입한다. 이 경우 합의의 절차 등에 관하여 필요한 사항은 보건복지부령으로 정한다. <개정 2008.2.29, 2010.1.18>
In cases where both parents are subscribers or former subscribers, the additional contribution periods pursuant to Paragraph ① shall be included only in the contribution periods of one of them, based on their agreement, and if no agreement is reached, they shall be equally distributed and included in each person's contribution periods. 제1항에 따라 가입기간을 추가로 산입하는데 필요한 재원은 국가가 전부 또는 일부를 부담한다.
The financial resources necessary for the additional inclusion of contribution periods pursuant to Paragraph ① shall be borne in whole or in part by the State.
제1항에 따른 자녀 수의 인정 방법 등에 관하여 필요한 사항은 대통령령으로 정한다. <신설 2025.4.2>
