제64조 분할연금 수급권자 등

혼인 기간(배우자의 가입기간 중의 혼인 기간으로서 별거, 가출 등의 사유로 인하여 실질적인 혼인관계가 존재하지 아니하였던 기간을 제외한 기간을 말한다. 이하 같다)이 5년 이상인 자가 다음 각 호의 요건을 모두 갖추면 그때부터 그가 생존하는 동안 배우자였던 자의 노령연금을 분할한 일정한 금액의 연금(이하 "분할연금"이라 한다)을 받을 수 있다. <개정 2011.12.31, 2017.12.19>
1. 배우자와 이혼하였을 것
2. 배우자였던 사람이 노령연금 수급권자일 것
3. 60세가 되었을 것
A person whose period of marriage (meaning the period of marriage during the spouse's coverage period, excluding periods where substantial marital relations did not exist due to reasons such as separation or desertion; hereinafter the same shall apply) is five years or longer, and who meets all the following requirements, may receive a certain amount of pension, which is a division of the former spouse's old-age pension, for the duration of their life from that point onward (hereinafter referred to as "pension division"). <Amended by Dec. 31, 2011, Dec. 19, 2017> 1. Having divorced the spouse. 2. The former spouse being a beneficiary of an old-age pension. 3. Having reached the age of 60.
제1항에 따른 분할연금액은 배우자였던 자의 노령연금액(부양가족연금액은 제외한다) 중 혼인 기간에 해당하는 연금액을 균등하게 나눈 금액으로 한다.
The amount of pension division under paragraph ① shall be the amount obtained by equally dividing the pension amount corresponding to the period of marriage from the former spouse's old-age pension amount (excluding dependent family allowances).
제1항에 따른 분할연금은 제1항 각 호의 요건을 모두 갖추게 된 때부터 5년 이내에 청구하여야 한다. <개정 2011.12.31, 2016.5.29>
A pension division under paragraph ① must be claimed within five years from the date when all the requirements in each subparagraph of paragraph ① are met. <Amended by Dec. 31, 2011, May 29, 2016>
제1항에 따른 혼인 기간의 인정 기준 및 방법 등에 필요한 사항은 대통령령으로 정한다. <신설 2017.12.19>
Matters necessary for the standards and methods for recognizing the period of marriage under paragraph ① shall be determined by Presidential Decree. <Newly established by Dec. 19, 2017>
