Article 64-4 (Waiver of Right to Receive Divided Pension)
제64조의4 분할연금 수급권의 포기

제64조제1항에 따른 분할연금 수급권자는 같은 항의 배우자였던 사람과 재혼한 경우 보건복지부령으로 정하는 바에 따라 분할연금 수급권의 포기를 신청할 수 있다.
A recipient of the right to receive a divided pension under Article 64(1) may apply to waive the right to receive the divided pension, in accordance with the provisions of the Ordinance of the Ministry of Health and Welfare, when remarrying the spouse from whom the divorce occurred, as referred to in the same paragraph.
제1항에 따라 분할연금 수급권자가 분할연금 수급권의 포기를 신청한 경우에는 그 분할연금 수급권은 신청한 날부터 소멸된다.
If a recipient of the right to receive a divided pension applies to waive the right to receive the divided pension pursuant to Paragraph ①, the right to receive the divided pension shall be extinguished from the date of application.
제2항에 따라 분할연금 수급권이 소멸된 경우에는 분할연금 수급권을 포기한 사람의 배우자에게 분할연금이 발생하기 전의 노령연금을 지급한다.
If the right to receive a divided pension is extinguished pursuant to Paragraph ②, the old-age pension that was payable before the divided pension was generated shall be paid to the spouse of the person who waived the right to receive the divided pension.
