제67조 장애연금의 수급권자

가입자 또는 가입자였던 자가 질병이나 부상으로 신체상 또는 정신상의 장애가 있고 다음 각 호의 요건을 모두 충족하는 경우에는 장애 정도를 결정하는 기준이 되는 날(이하 "장애결정 기준일"이라 한다)부터 그 장애가 계속되는 기간 동안 장애 정도에 따라 장애연금을 지급한다. <개정 2016.5.29>
1. 해당 질병 또는 부상의 초진일 당시 연령이 18세(다만, 18세 전에 가입한 경우에는 가입자가 된 날을 말한다) 이상이고 노령연금의 지급 연령 미만일 것
2. 다음 각 목의 어느 하나에 해당할 것
- 가. 해당 질병 또는 부상의 초진일 당시 연금보험료를 낸 기간이 가입대상기간의 3분의 1 이상일 것
- 나. 해당 질병 또는 부상의 초진일 5년 전부터 초진일까지의 기간 중 연금보험료를 낸 기간이 3년 이상일 것. 다만, 가입대상기간 중 체납기간이 3년 이상인 경우는 제외한다.
- 다. 해당 질병 또는 부상의 초진일 당시 가입기간이 10년 이상일 것
If an insured person or a former insured person has a physical or mental disability due to illness or injury and meets all of the following requirements, a disability pension shall be paid according to the degree of disability for the period during which the disability continues from the date used to determine the degree of disability (hereinafter referred to as the "Disability Determination Standard Date"). <Amended by Act No. 13717, May 29, 2016> 1. The age at the date of first medical examination for the relevant illness or injury shall be 18 years or older (however, if insured before the age of 18, it shall be the date of becoming insured) and younger than the age for receiving an old-age pension. 2. Shall fall under any of the following: a. The period during which pension insurance premiums were paid at the date of first medical examination for the relevant illness or injury shall be one-third or more of the eligible insured period. b. The period during which pension insurance premiums were paid from 5 years before the date of first medical examination for the relevant illness or injury until the date of first medical examination shall be 3 years or more. Provided, that cases where the period of arrears within the eligible insured period is 3 years or more shall be excluded. c. The insured period at the date of first medical examination for the relevant illness or injury shall be 10 years or more.
제1항에 따른 장애결정 기준일은 다음 각 호에서 정하는 날로 한다. <개정 2016.5.29>
1. 초진일부터 1년 6개월이 지나기 전에 완치일이 있는 경우: 완치일
2. 초진일부터 1년 6개월이 지날 때까지 완치일이 없는 경우: 초진일부터 1년 6개월이 되는 날의 다음 날
3. 제2호에 따른 초진일부터 1년 6개월이 되는 날의 다음 날에 장애연금의 지급 대상이 되지 아니하였으나, 그 후 그 질병이나 부상이 악화된 경우: 장애연금의 지급을 청구한 날(제61조에 따른 노령연금 지급연령 전에 청구한 경우만 해당한다. 이하 이 조에서 "청구일"이라 한다)과 완치일 중 빠른 날
4. 제70조제1항에 따라 장애연금의 수급권이 소멸된 사람이 장애연금 수급권을 취득할 당시의 질병이나 부상이 악화된 경우: 청구일과 완치일 중 빠른 날
The Disability Determination Standard Date under Paragraph ① shall be the date determined in each of the following subparagraphs. <Amended by Act No. 13717, May 29, 2016> 1. If there is a date of complete recovery within 1 year and 6 months from the date of first medical examination: the date of complete recovery. 2. If there is no date of complete recovery within 1 year and 6 months from the date of first medical examination: the day after 1 year and 6 months from the date of first medical examination. 3. If the person was not eligible for disability pension on the day after 1 year and 6 months from the date of first medical examination under Subparagraph 2, but the illness or injury subsequently worsened: the earlier of the date of claim for disability pension (limited to cases claimed before the age of eligibility for old-age pension under Article 61. Hereinafter referred to as "Claim Date" in this Article) and the date of complete recovery. 4. If the illness or injury at the time of acquiring the right to receive a disability pension, for a person whose right to receive a disability pension has been extinguished under Article 70 (1), has worsened: the earlier of the Claim Date and the date of complete recovery.
제1항에 따라 장애연금의 지급 대상이 되는 경우에도 불구하고 다음 각 호의 어느 하나에 해당되는 경우에는 장애연금을 지급하지 아니한다. <개정 2016.5.29>
1. 초진일이 제6조 단서에 따라 가입 대상에서 제외된 기간 중에 있는 경우
2. 초진일이 국외이주ㆍ국적상실 기간 중에 있는 경우
3. 제77조에 따라 반환일시금을 지급받은 경우
Notwithstanding the eligibility for disability pension under Paragraph ①, a disability pension shall not be paid if any of the following subparagraphs apply. <Amended by Act No. 13717, May 29, 2016> 1. The date of first medical examination falls within the period excluded from the eligible insured period according to the proviso of Article 6. 2. The date of first medical examination falls within the period of emigration abroad or loss of nationality. 3. If a lump-sum refund has been paid under Article 77.
장애 정도에 관한 장애등급은 1급, 2급, 3급 및 4급으로 구분하되, 등급 구분의 기준과 장애 정도의 심사에 관한 사항은 대통령령으로 정한다. <개정 2016.5.29>
