제76조 유족연금의 지급 정지

유족연금의 수급권자인 배우자에 대하여는 수급권이 발생한 때부터 3년 동안 유족연금을 지급한 후 55세가 될 때까지 지급을 정지한다. 다만, 그 수급권자가 다음 각 호의 어느 하나에 해당하면 지급을 정지하지 아니한다. <개정 2015.1.28, 2016.5.29, 2023.6.13>
1. 제52조의2에 따른 장애상태인 경우
2. 가입자 또는 가입자였던 자의 25세 미만인 자녀 또는 제52조의2에 따른 장애상태인 자녀의 생계를 유지한 경우
3. 대통령령으로 정하는 소득이 있는 업무에 종사하지 아니하는 경우
For a spouse who is a recipient of a survivor's pension, after paying the survivor's pension for three years from the date the right to receive it arises, payment shall be suspended until the recipient reaches the age of 55. Provided, that if such recipient falls under any of the following subparagraphs, payment shall not be suspended. 1. In case of a disability status under Article 52-2. 2. In case of maintaining the livelihood of a child under 25 years of age of the insured person or former insured person, or a child with a disability status under Article 52-2. 3. In case of not being engaged in gainful employment as prescribed by Presidential Decree.
유족연금의 수급권자인 배우자의 소재를 1년 이상 알 수 없는 때에는 유족인 자녀의 신청에 의하여 그 소재 불명(不明)의 기간동안 그에게 지급하여야 할 유족연금은 지급을 정지한다.
If the whereabouts of a spouse who is a recipient of a survivor's pension cannot be ascertained for one year or more, the survivor's pension that should have been paid to the spouse shall be suspended for the period of the unknown whereabouts, upon the application of the child who is a survivor.
배우자 외의 자에 대한 유족연금의 수급권자가 2명 이상인 경우 그 수급권자 중에서 1년 이상 소재를 알 수 없는 자가 있으면 다른 수급권자의 신청에 따라 그 소재 불명의 기간에 해당하는 그에 대한 유족연금의 지급을 정지한다.
If there are two or more recipients of a survivor's pension other than a spouse, and the whereabouts of one of them cannot be ascertained for one year or more, the payment of the survivor's pension to that person for the period of unknown whereabouts shall be suspended, upon the application of another recipient.
제2항과 제3항에 따라 유족연금의 지급이 정지된 자의 소재가 확인된 경우에는 본인의 신청에 의하여 지급 정지를 해제한다.
If the whereabouts of a person whose survivor's pension payment has been suspended under paragraphs 2 and 3 are confirmed, the suspension of payment shall be lifted upon their application.
자녀나 손자녀인 수급권자가 다른 사람에게 입양된 때에는 그에 해당하게 된 때부터 유족연금의 지급을 정지한다. <신설 2017.10.24>
When a child or grandchild who is a recipient is adopted by another person, the payment of the survivor's pension shall be suspended from the date they become eligible for adoption.
제5항에 따라 유족연금의 지급이 정지된 자가 파양된 경우에는 본인의 신청에 의하여 파양된 때부터 지급 정지를 해제한다. <신설 2017.10.24>
If a person whose survivor's pension payment has been suspended under paragraph 5 is divorced from the adoption, the suspension of payment shall be lifted from the date of divorce upon their application.
장애로 수급권을 취득한 자가 제52조의2에 따른 장애상태에 해당하지 아니하게 된 때에는 그에 해당하게 된 때부터 유족연금의 지급을 정지한다. <신설 2017.10.24, 2023.6.13>
When a person who acquired the right to receive a pension due to a disability is no longer in a disability status under Article 52-2, the payment of the survivor's pension shall be suspended from the date they cease to be in such status.
제7항에 따라 유족연금의 지급이 정지된 자가 그 질병이나 부상이 악화되어 제52조의2에 따른 장애상태에 해당하게 된 경우에는 본인의 신청에 의하여 제52조의2에 따른 장애상태에 해당하게 된 때부터 지급 정지를 해제한다. <신설 2017.10.24, 2023.6.13>
If a person whose survivor's pension payment has been suspended under paragraph 7 becomes again eligible for a disability status under Article 52-2 due to the worsening of their illness or injury, the suspension of payment shall be lifted from the date they become eligible for such disability status under Article 52-2, upon their application.
제2항 및 제3항에도 불구하고 유족연금 수급권자가 1년 이상 소재불명이고 제2항 및 제3항에 따른 지급 정지의 신청을 할 사람이 존재하지 아니하는 등 대통령령으로 정하는 경우에는 유족연금의 지급을 정지할 수 있다. <신설 2021.12.21>
Notwithstanding paragraphs 2 and 3, if a recipient of a survivor's pension has unknown whereabouts for one year or more, and there is no one to apply for suspension of payment under paragraphs 2 and 3, or under other circumstances prescribed by Presidential Decree, the survivor's pension may be suspended.
제9항에 따른 지급 정지에 대한 취소 및 그에 따른 지급에 대해서는 제86조의2제2항 및 제3항을 준용한다. <신설 2021.12.21>
The rescission of suspension of payment under paragraph 9 and the subsequent payment shall be governed by the provisions of Article 86-2, paragraphs 2 and 3.
