제80조 사망일시금

다음 각 호의 어느 하나에 해당하는 사람이 사망한 때에 제73조에 따른 유족이 없으면 그 배우자ㆍ자녀ㆍ부모ㆍ손자녀ㆍ조부모ㆍ형제자매 또는 4촌 이내 방계혈족(傍系血族)에게 사망일시금을 지급한다. 다만, 가출ㆍ실종 등 대통령령으로 정하는 경우에 해당하는 사람에게는 지급하지 아니하며, 4촌 이내 방계혈족의 경우에는 대통령령으로 정하는 바에 따라 다음 각 호의 어느 하나에 해당하는 사람의 사망 당시(「민법」 제27조제1항에 따른 실종선고를 받은 경우에는 실종기간의 개시 당시를, 같은 조 제2항에 따른 실종선고를 받은 경우에는 사망의 원인이 된 위난 발생 당시를 말한다) 그 사람에 의하여 생계를 유지하고 있던 사람에게만 지급한다. <개정 2011.12.31, 2016.5.29, 2020.12.29>

3. 장애등급이 3급 이상인 장애연금 수급권자
When a person falling under any of the following subparagraphs dies, if there are no bereaved family members as prescribed by Article 73, a lump-sum death benefit shall be paid to the spouse, children, parents, grandchildren, grandparents, siblings, or collateral relatives within the fourth degree of kinship of the deceased. However, in cases prescribed by Presidential Decree, such as absence or disappearance, the benefit shall not be paid to persons falling under such cases, and in the case of collateral relatives within the fourth degree of kinship, the benefit shall only be paid to those who were supported by the deceased at the time of the deceased's death, as prescribed by Presidential Decree (in the case of a declaration of absence under Article 27 (1) of the Civil Act, it means the time of the commencement of the period of absence; in the case of a declaration of absence under Article 27 (2) of the same Act, it means the time of the occurrence of the peril that caused death). <Amended by Act No. 11156, Dec. 31, 2011; Act No. 14174, May 29, 2016; Act No. 17872, Dec. 29, 2020> 1. 제1항에 따른 사망일시금은 다음 각 호의 금액으로 한다. <개정 2020.12.29>
1. 제1항제1호에 해당하는 경우: 가입자 또는 가입자였던 사람의 반환일시금에 상당하는 금액. 다만, 사망한 가입자 또는 가입자였던 사람의 최종 기준소득월액을 제51조제1항제2호에 따른 연도별 재평가율에 따라 사망일이 속하는 해의 전년도의 현재가치로 환산한 금액과 같은 호에 준하여 산정한 가입기간 중 기준소득월액의 평균액 중에서 많은 금액의 4배를 초과하지 못한다.
2. 제1항제2호 또는 제3호에 해당하는 경우: 수급권자가 사망할 때까지 지급받은 연금액이 제1호를 준용하여 산정한 금액(이 경우 "가입자 또는 가입자였던 사람"은 "노령연금 수급권자 또는 장애등급이 3급 이상인 장애연금 수급권자"로 본다)보다 적은 경우에 그 차액에 해당하는 금액
The lump-sum death benefit under paragraph ① shall be the amount specified in each of the following subparagraphs. <Amended by Act No. 17872, Dec. 29, 2020> 1. In the case of falling under subparagraph 1 of paragraph ①: An amount equivalent to the refund lump sum for the insured person or former insured person. Provided, That it shall not exceed four times the average monthly standard income during the period of insurance, calculated in accordance with subparagraph 2 of Article 51 (1) by revaluing the final monthly standard income of the deceased insured person or former insured person to the present value of the year preceding the year in which the death occurred, whichever is greater. 2. In the case of falling under subparagraph 2 or 3 of paragraph ①: If the total pension amount received by the beneficiary until death is less than the amount calculated by applying subparagraph 1 (in this case, "insured person or former insured person" shall be deemed "recipient of an old-age pension or recipient of a disability pension with a disability grade of 3 or higher"), the amount equivalent to the difference.
제2항제1호 및 제2호에 모두 해당하는 경우에는 제2호를 적용한다. <신설 2020.12.29>

제1항에 따른 사망일시금을 받을 자의 순위는 배우자ㆍ자녀ㆍ부모ㆍ손자녀ㆍ조부모ㆍ형제자매 및 4촌 이내의 방계혈족 순으로 한다. 이 경우 순위가 같은 사람이 2명 이상이면 똑같이 나누어 지급하되, 그 지급 방법은 대통령령으로 정한다. <개정 2020.12.29>
The order of priority for receiving the lump-sum death benefit under paragraph ① shall be spouse, children, parents, grandchildren, grandparents, siblings, and collateral relatives within the fourth degree of kinship.
